WHEREAS, the City of Miami ("City") has applied for a federal grant as part of the Federal
stimulus package for transit projects; and

WHEREAS, Federal Transit Administration ("FTA") Section 5307 funds in the amount of
$4,084,282 have been allocated to the City by the American Recovery and Reinvestment Act (ARRA)
for a transit capital project; and
WHEREAS, the City's transit project consists of purchasing rubber -tire trolley buses and ancillary
capital equipment such as signage, bus benches and bus shelters which will be used to provide transit
circulator service in the Downtown, Brickell, Health District, Allapattah, Overtown, and Coral Way
neighborhoods; and
WHEREAS, Miami -Dade Transit ("MDT") is the designated recipient of federal transit funds in
Miami -Dade County and will serve as the local pass-through agency for the FTA Section 5307 funds to
be provided to the City; and
WHEREAS, an Interlocal Agreement with MDT will be required in order to access the Federal
Section 5307 funds to be provided to the City; and
WHEREAS, this Resolution is necessary in order to meet FTA's grant application deadline
requiring Interlocal Agreements with MDT along with project documentation by June 1, 2009; and
WHEREAS, in consideration of the short timeframe allotted to provide FTA with the necessary
documents to obligate the federal stimulus funds, the City Manager requests authority to execute the
Interlocal Agreement with MDT, in substantially the attached form; and

WHEREAS, all ensuing agreements executed pursuant to this resolution and final award amounts
will be subsequently reported back to the City Commission by the City Manager; and
WHEREAS, the federal stimulus funds provided by FTA through MDT will be appropriated by
separate resolution(s);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings found in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1) to execute the Interlocal Agreement with MDT, in
substantially the attached form, required for a pass-through of a federal grant to be allocated to the
City as part of the federal stimulus package for transit projects, currently consisting of $4,084,282, for
the City to purchase rubber -tire trolley buses and ancillary capital equipment such as signage, bus
benches, and bus shelters to provide transit circulator service in the Downtown, Brickell, Health
District, Allapattah, Overtown, and Coral Way neighborhoods, and to implement acceptance of said
contribution of funds to be appropriated by separate resolution(s).
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2)

(1) The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
