HomeMy WebLinkAboutR-09-0257Vop City of Miami Legislation < U R �O Resolution: R-09-0257 File Number: 09-00562 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/28/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE FINDING OF NECESSITY REPORT, ATTACHED AND INCORPORATED AS EXHIBIT "A," FOR THE AREA PROPOSED TO BE INCLUDED IN THE OMNI REDEVELOPMENT DISTRICT REDEVELOPMENT AREA ("STUDY AREA"), AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "B," ATTACHED AND INCORPORATED; FINDING THAT THE REBUILDING, REHABILITATION, CONSERVATION, AND REDEVELOPMENT OF THE STUDY AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY, MORALS, AND WELFARE OF THE RESIDENTS OF THE CITY OF MIAMI AND MIAMI-DADE COUNTY; FINDING THAT THE STUDY AREA CONSTITUTES A SLUM OR BLIGHTED AREA AS DEFINED IN SECTION 163.340, FLORIDA STATUTES; DIRECTING THE CITY MANAGER TO TRANSMIT A COPY OF THE FINDING OF NECESSITY REPORT TO MIAMI-DADE COUNTY FOR REVIEW AND CONSIDERATION. WHEREAS, the Omni Redevelopment District Community Redevelopment Agency ("Omni CRA") is responsible for carrying out community redevelopment activities and projects within the Redevelopment Area in accordance with its approved Redevelopment Plan ("Plan"); and WHEREAS, on December 31, 2007, the City of Miami, Miami -Dade County and the Omni CRA entered into an Interlocal Agreement, which provided, among other things, for the expansion of the boundaries of the Omni Redevelopment District Redevelopment Area and the extension of its life ("Interlocal Agreement"); and WHEREAS, in accordance with Section 163.355, Florida Statutes, a Finding of Necessity Report was prepared for the area proposed to be included in the Omni Redevelopment District Redevelopment Area ("Study Area"), as more particularly described in Exhibit "B," attached and incorporated; and WHEREAS, the City Commission has reviewed the Finding of Necessity Report; and WHEREAS, the City Commission finds that the Study Area constitutes a slum or blighted area, as defined in Section 163.340, Florida Statutes; and WHEREAS, the City Commission finds that the rebuilding, rehabilitation, conservation, and redevelopment of the Study Area is necessary in the interest of the public health, safety, morals, and welfare of the residents of the City of Miami and Miami -Dade County; and WHEREAS, the City Commission wishes to accept the Finding of Necessity Report and directs the City Manager to transmit a copy of said report to Miami -Dade County for its review and consideration; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, City of Miand Page 1 of 2 File Id. 09-00562 (Version: 2) Printed On: 6/21/2017 File Number: 09-00562 Enactment Number: R-09-0257 FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The Miami City Commission accepts the Finding of Necessity Report, attached and incorporated as Exhibit "A," for the Study Area, as more particularly described in Exhibit "B," attached and incorporated. Section 3. The Miami City Commission finds that the rebuilding, rehabilitation, conservation, and redevelopment of the Study Area is necessary in the interest of the public health, safety, morals, and welfare of the residents of the City of Miami and Miami -Dade County. Section 4. The Miami City Commission finds that the Study Area constitutes a slum or blighted area, as defined in Section 163.340, Florida Statutes. Section 5. The City Manager is directed to transmit a copy of the Finding of Necessity Report to Miami -Dade County for review and consideration. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
