TAMIAMI STORM SEWER IMPROVEMENTS,

This Amendment No. 1 to the Contract dated August 18, 2008, (the
"Contract") between the City of Miami, a municipal corporation of the State of
Florida ("CITY"), and Horizon Contractors Inc. ("CONTRACTOR") for the project
entitled "Tamiami Storm Sewer Improvements, B-50676," ("PROJECT") is
entered into this day of 2009.
RECITALS
WHEREAS, the Contract was entered into pursuant to the approval of the
City Commission by Resolution No. 08-0403 in the total amount of $1,079,448,
which included $969,448, for the Scope of Work and $110,000 for the owner
contingency, as stated in the original Contract Documents for the PROJECT; and
WHEREAS, it is now necessary to amend the Scope of Work to include
additional work due to owner requested changes and unforeseen conditions such
as essential drainage, street and sidewalk improvements; and,
NOW THEREFORE, for the considerations hereinafter set forth:
The Agreement dated August 18, 2008, is hereby amended as follows:
1. ADDITIONAL WORK is hereby revised to include all labor, materials
and equipment required to perform the additional work due to owner
requested changes and unforeseen conditions The Additional Work
shall be performed in a manner consistent will all applicable terms and
conditions of the Contract Documents.
2. CONTRACT SUM is hereby increased by an amount not to exceed
$189,000, thereby increasing the total Contract Sum to One Million
Two Hundred Sixty Eight Thousand Four Hundred Forty Eight Dollars
($1,268,448).
All other terms and conditions of the Contract are in effect and remain
unchanged.
