HomeMy WebLinkAboutLegislation SRFile Number: 09-00286 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD STREET WIDTHS," BY REDUCING THE ZONED STREET WIDTH OF NORTH MIAMI AVENUE BETWEEN NORTH 11TH TERRACE AND NORTH 14TH STREET, MIAMI, FLORIDA, FROM NINETY FIVE (95) FEET TO SEVENTY (70) FEET; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of the Code of the City of Miami, Florida, as amended ("City Code") establishes base building line locations for all public streets within the City of Miami ("City"); and WHEREAS, North Miami Avenue between North 11th Terrace and North 14th Street, Miami, Florida, was originally dedicated as a seventy (70) foot wide roadway; and WHEREAS, the zoned street width of this roadway was increased to ninety five (95) feet wide but has not been dedicated or developed to the ninety five (95) foot width; and WHEREAS, the City's Administration review of this transportation corridor reveals that the current seventy (70) foot wide developed roadway adequately serves the present and future transportation needs of the public; and WHEREAS, to accommodate the pedestrian and traffic impacts, utility and access needs compatible with new development now being realized in this area, a reduction in the zoned street width of North Miami Avenue between North11th Terrace and North14th Street, Miami, Florida, from ninety five (95) feet to seventy (70) feet is warranted; and WHEREAS, the reduction of the zoned street width will reduce the amount of right of way dedication required from adjacent private property; and WHEREAS, required building setbacks will be measured from the reduced width base building line; and WHEREAS, the Departments of Police, Fire -Rescue, and Solid Waste have evaluated the effect of the reduction of the zoned street width of these roadways on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Chapter 54/Article V/Section 54-190 of the City Code, entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths," is amended in the following particulars: {1} "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE V. BASE BUILDING LINES Sec. 54-190. Nonstandard street widths. Base building lines shall be located from the centerline as specified for each of the following streets: Streets, Avenues, Roads Etc., in Alphabetical Order: Distance in Feet from Centerline to Base Building Line (253) Miami Avenue, North, North 5th Street to North 8th Street and North 9th Street to North 44th StFeet 11th Terrace...........................................47.5 (254) Miami Avenue, North, North 8th Street To North 9th Street and North 14th -Street 11th Terrace to North 36th Street..........................................35 Section 3. If any Section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4.
