A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "PROGRAMS
FOR THE DEVELOPMENTALLY DISABLED, 2008 -2011," APPROPRIATING
FUNDS FOR ITS OPERATION, AND AUTHORIZING THE CITY MANAGER TO
ACCEPT ANTICIPATED PAYMENT FOR SERVICES IN THE ESTIMATED TOTAL
AMOUNT OF SIX HUNDRED THOUSAND, FIVE HUNDRED AND EIGHTY --TWO

AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE A
MEDICAID WAIVER SERVICES AGREEMENT, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY AND THE RISK MANAGEMENT DIRECTOR
("AGREEMENT"), WITH THE AHCA, MEDICAID PROGRAM DEVELOPMENT
THROUGH THE FLORIDA AGENCY FOR PERSONS WITH DISABILITIES, TO
FUND ON A REIMBURSEMENT BASIS, SUBJECT TO STATE APPROPRIATIONS,
SERVICES AND PROGRAMS FOR THE DEVELOPMENTALLY DISABLED WHICH
ARE ADMINISTERED BY THE CITY OF MIAMI'S DEPARTMENT OF PARKS AND
RECREATION THROUGH ITS PROGRAMS FOR PERSONS WITH DISABILITIES
DIVISION, DURING THE PERIOD OF JULY 1, 2008 THROUGH JULY 1, 2011;
AUTHORIZING THE CITY MANAGER AND ALL OTHER NECESSARY CITY
OFFICIALS TO EXECUTE, SUBJECT TO APPROVAL BY THE CITY ATTORNEY,
ALL OTHER NECESSARY DOCUMENTS TO ACCEPT SAID FUNDS AND TO
COMPLY WITH SAID AGREEMENT.
WHEREAS, the City of Miami's ("City's") Department of Parks and Recreation's Programs for
Persons with Disabilities Division obtains funds to support its Home and Community -Based Services
("HCBS") and Family and Supported Living ("FSL") programs through the State of Florida Agency for
Health Care Administration's ("AHCA") funding for persons with developmental disabilities
administered by the Florida Agency for Persons with Disabilities ("APD"); and
WHEREAS, the AHCA through APD is providing to the City funds, on a reimbursement basis, in
the estimated amount of two hundred thousand, one hundred and ninety-four dollars ($200,194) per
year, for a three-year period, commencing July 1, 2008 through July 1, 2011, subject to state
appropriations, in payment for HCBS and FSL services and programs being provided and to be
provided within the City to developmentally disabled individuals, for an estimated total amount of six
hundred thousand, five hundred and eighty-two dollars ($600,582);
WHEREAS, the City (1) has previously entered into the prerequisite Medicaid Provider Agreement,
(2) has received a Medicaid Provider number, (3) has been requested by APD to execute a new
Medicaid Waiver Service Agreement, in order to continue HCBS and FSL programs and services
previously administered Linder the earlier Medicaid Provider Agreement, and (4) is in the processes of
negotiating certain provisions of the new Medicaid Provider Agreement with APD that will need to be
completed and executed before the City Commission returns in September in order to continue AHCA

funding to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2, The following new Special Revenue Fund is established as described herein:

ADMINISTRATION MEDICAID PROGRAM DEVELOPMENT THROUGH
STATE OF FLORIDA AGENCY FOR PERSONS WITH DISABILITIES $600,582
APPROPRIATION: PROGRAMS FOR THE DEVELOPMENTALLY
DISABLED, 2008-2011 $600,582
Section 3. The City Manager is authorized(l) to accept anticipated payment for services in the
estimated total amount of six hundred thousand, five hundred and eighty-two dollars ($600,582) from
and to negotiate and execute a Medicaid Waiver Services Agreement, in a form acceptable to the City
Attorney and the Risk Management Director ("Agreement"), with the ARCA, Medicaid Program
Development through the Florida Agency for Persons with Disabilities, to fund on a reimbursement
basis, subject to state appropriations, services and programs within the City for the developmentally
disabled which are administered by the City's Department of Parks and Recreation through its
Programs for Persons with Disabilities Division, during the period of July 1, 2008 through July 1, 2011.
Section 4. The City Manager and all other necessary City officials are authorized to execute,
subject to approval by the City Attorney, all other necessary documents to accept said funds and to
comply with said Agreement.
Section 5. This Resolution shall become effective immediately upon it adoption and signature of
the Mayor.(2}

{1 } The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} if the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
