Subject: Revocable License Agreement with Rickenbacker Marina, Inc. for Use of City -owned Boat Launch
Background Information:
Rickenbacker Marina, Inc. ("Licensee") currently operates a marina on City -owned property located at Virginia
Key. The Licensee has expressed an interest in using the City -owned boat launch area, located on adjacent
property, for its existing operation. The administration has evaluated the request and has determined that it
would be in the best interest of the City to enter into a Revocable License Agreement ("Agreement") with the
Licensee for the City to receive market fees based on a recent appraisal.
The proposed Agreement will allow the Licensee to use approximately 1,440 square feet of City -owned
property located at 3501 Rickenbacker Causeway. The proposed Agreement will commence upon the City
Manager's signature, shall continue on a month-to-month basis, and may be terminated by the City Manager,
upon providing thirty (30) day written notice to the Licensee. Furthermore, the proposed Agreement
authorizes the City to collect monthly fees from the Licensee, in the initial amount of $4,500 per month, plus
State of Florida Use tax (if applicable), ten percent (10%) of which the City will reserve in a special revenue
account for the Area's capital improvements, with the terms and conditions set forth in the Agreement.
