Purpose of Item:
Authorize the City Manager to execute a Revocable License Agreement ("Agreement"), in substantially the!
attached form, between the City of Miami ("City") and Rickenbacker Marina, Inc. a Florida for profit',
corporation (the "Licensee"), to use approximately 20,594 square feet, or 0.473 acres, of City -owned property
located at 3301 Rickenbacker Causeway, Miami, Florida, for the purpose of providing additional parking for
the Licensee's operation, commencing from the Effective Date, with the Licensee to pay a monthly use fee to
the City of $500.00, plus State of Florida Use Tax, if applicable, with additional terms and conditions as more
particularly set forth in said Agreement.

Subject: Revocable License Agreement with Rickenbacker Marina, Inc. for Additional Parking Space
Background Information:
On August 5, 1985, the City issued Revocable Permit No. 5 ("Permit") to Marina Biscayne, Ltd. ("Permitee")
for the use of property located at 3301 Rickenbacker Causeway, Miami, Florida, more specifically the area
identified as Marine Stadium Complex Parcel No. 3 ("Area"), to provide the Permitee with additional parking
for its existing operations. The Permit was valid for a period commencing August 5, 1985 and ending on
August 4, 1986, with unlimited one-year renewal options subject to the approval of the City Manager.
Pursuant to Section 4 of the Permit, the Permitee was responsible for paying a $1,200.00 per year fee, in
addition to any applicable tax, for the use of the Area.
The administration has evaluated the terms of the Permit and has determined that it would be in the best
interest of the City to terminate the Permit, pursuant to Section 2, and enter into a Revocable License
Agreement ("Agreement") with Rickenbacker Marina, Inc. ("Licensee") for the City to receive market fees
based on a recent appraisal. The proposed Agreement will allow the Licensee to occupy and use
approximately 20,594 square feet of City -owned property located at 3301 Rickenbacker Causeway, and to
provide the Licensee with additional parking for its existing operations. The proposed Agreement will
commence upon the City Manager's signature and shall continue on a month-to-month basis. The proposed
Agreement may be terminated by the City Manager, upon providing thirty (30) day written notice to the
Licensee. Furthermore, the proposed Agreement authorizes the City to collect monthly fees from the
Licensee, in the initial amount of $500 per month, plus State of Florida Use Tax (if applicable), ten percent
(10%) of which the City will reserve in a special revenue fund account for the Area's capital improvements,
with the terms and conditions set forth in the Agreement.
