Appeal for Variance Request Denial
Dear Nis. Perrandez.
'Last week on Monday October 20'x, e went before the City of Miami Haring Board to present our
request for variances for the above mentioned propel, ho r, our request was subsequently deqied.
We now submit a formal request for appeal of the bear i g Boards decisiorg based on the following'.
Our request for a r aaxafion of the open space requirements Js based on the fact that the building is
existing and the use of the property's open space has been maximized. We have expanded the total
area of open/landscape space from the existing 326 Sq. Ft. to 1,1932 Sq. Ft.. Additionally, we now provide
full compliant handicap parking space with an access aisle and do not reduce the total number of
parking spaces provided.
According to Zoning Ordinance 907.2.2.1, $50,00 would have to be paid for every Sq. Ft of opei, space
not provided and waived. Such a requirement -would total $65,000 in our case. This is highly unfair and
could be classified as ars € nj st penalty for anyone attempting to renovate or beautify an existing lot.
Also, its our understanding that this particular ordinance is in fact now being re-evaluated for this very
reason
Regarding our request for a waiver of the 13 parking spaces required for the proposed Restaurant use,
e would like to restate that there is a need for a new restaurant/cafe in this neighborhood; the workers in
the nearby office buildings and the residents of the area would benefit from. its addition. And, as as
observed in a previous zoning analysis, dime to the fact that in the daytime most patrons to the cafe would
be pedestrians and that during the evening hers the parking spaces would be vacated by the office
workers. there =old be no adverse effects to the adjacent areas due to lack of parking,
We respectfully request that you grant us ars appeal and approve the requested variance for these two
items; in doing so you would allow us to proceed and obtain the building permit we seek and cor i` enQe
the renovation of the property.
