Minority Construction Employment Plan9�' 1 MIAMI TM BALLPARK MINORITY CONSTRUCTION EMPLOYMENT PLAN FEBRUARY 2009 Minority Construction Employment Plan The Florida Marlins, City of Miami, and Miami -Dade County are fully committed to ensuring that employee hiring and promotions, as well as vendor and contractor hiring, be strictly based on merit, qualifications and competency and that applicable personnel practices will not be .influenced by an applicant's or employee's race, color, place of birth, religion, national origin, sexual orientation, gender, age, marital status, veteran status or handicapped status. The Florida Marlins and Major League Baseball have a pro -active history of promoting the economic growth, strength and well being of diverse communities. In 1998, Major League Baseball authorized the creation of an economically driven business initiative established to cultivate new and existing partnerships with minority- and women -owned businesses. The Diversity Business Partners Program aims at increasing opportunities for minorities and women to participate in the procurement activities of Major League Baseball. Since the formation of the Diversity Business Partners Program, Major League Baseball and its teams have incurred expenditures of over $300 million with mu-tority- and women -owned businesses. The program has been recognized as an industry-leading initiative and, recently, Major League Baseball was honored as one of the top 50 corporations in the nation for multicultural businesses by DiversityBusiness.com. As part of its commitment to diversity, the Florida Marlins and its affiliates will ensure the application of non-discriminatory personnel practices, including the following: 1. Taking all necessary action to attract and retain qualified employees, regardless of race, color, place of birth, religion, national origin, gender, sexual orientation, age, marital status, veteran and handicapped status 2. Maintaining equitable principles in the recruitment, hiring, training, compensation and promotion of employees; and 3. Monitoring and reviewing personnel practices to guarantee that equal opportunities are being provided to all employees, regardless of race, color, place of birth, religion, national origin, gender, sexual orientation, age, marital status, veteran and handicapped status. In addition, the Florida Marlins and its affiliates continue to aggressively pursue practices that will serve to enable local and disadvantaged vendors and contractors opportunities to contract with the Florida Marlins. Specifically, the Florida Marlins, as part of the Construction Administration Agreement and Management Agreement to be entered into with Miami - Dade County and the City of Miami, have agreed to the following: (a) Develop an aggressive small business outreach program to increase participation of small businesses in the operations of the Baseball Stadium; (b) Afford local, small and disadvantaged businesses in Miami - Dade County and the City of Miami an equal opportunity to compete for business for the supply of goods and services to the operator of the Baseball Stadium; (c) Adopt an affirmative action plan that sets forth procedures that the Florida Marlins and its affiliates will utilize to assure that it does not discriminate in its employment, promotion and procurement practices; (d) Require that all contracts for architectural work include provisions mandating that the architect make reasonable good faith efforts to ensure compliance with the goals set forth under Miami -Dade County's Community Business Enterprise - Architects and Engineers Program (CBE- A/E); (e) Require that any construction management contract include provisions mandating compliance with Miami -Dade County's Community Small Business Enterprise programs (CSBE and SBE) and Community Workforce programs ("CWP"); and (f) Establish a small business program monitoring and assistance program, which will be assigned one full-time staff person to monitor and assist the Florida Marlins and its affiliates with compliance with the CBE- A/E, CSBE, SBE, CWP, and other similar programs. # 6040373 vl
