AND LABSOURCE, INC, PURSUANT TO SECTION 2.29, B., "TERMINATION FOR CONVENIENCE"; ACCEPTING THE BIDS RECEIVED FEBRUARY 3, 2009, PURSUANT TO INVITATION FOR BIDS NO. 107067,4, FROM VARIOUS LOWEST RESPONSIVE AND RESPONSIBLE BIDDERS, FOR THE RE -PROCUREMENT OF WORK AND LATEX GLOVES (INCLUDING ADDITIONAL GLOVES NOT CONTAINED IN THE PRIOR BID CONTRACT), ON A CITYWIDE, AS -NEEDED CONTRACTUAL BASIS, FOR AN INITIAL CONTRACT PERIOD OF TWO (2) YEARS, WITH THE OPTION TO RENEW FOR TWO (2) ADDITIONAL ONE (1) YEAR PERIODS; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS FROM THE USER DEPARTMENTS AND AGENCIES, SUBJECT TO AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, pursuant to Resolution No. 08-0622, adopted November 13, 2008, the Miami City Commission awarded a bid to Fisher Scientific Company L.L.C. and Labsource, Inc., for the purchase of work and latex gloves, on a Citywide, as -needed contractual basis, for an initial contract period of two (2) years, with the option to renew for two (2) additional one (1) year periods; and WHEREAS, both Fischer Scientific Company L.L.C. and Labsource, Inc. (herein referred to as "Suppliers") were experiencing difficulty of honoring contractual prices given due to the high costs of petroleum based products; and WHEREAS, the City of Miami ("City") acknowledges that petroleum is a commodity that fluctuates in pricing; and WHEREAS, the City and the Suppliers could no longer conduct business under Invitation for Bid Contract No. 70054 due to the instability and volatility of the market for petroleum based products; and WHEREAS, the Suppliers were requesting contractual increases on work and latex gloves apparently purchased during a timeframe where prices were increasing, but price increase requests were submitted several months later, when market prices for petroleum based products were decreasing; and WHEREAS, both the City and the Suppliers decided to amicably vacate the contract; and WHEREAS, the Purchasing Department before issuing Invitation for Bid No. 107067, 4, worked with all end-user departments requesting these gloves, to make the specifications less restrictive and City of Miand Page 1 of 2 File Id. 09-00366 (Version: 1) Printed On: 6/6/2017 File Number: 09-00366 Enactment Number: R-09-0195 to add gloves considered to be "approved equals", so it can be provided by most suppliers; and WHEREAS, the Purchasing Department also included a contractual clause that allow for price revisions at predetermined levels and has rebid all items and greatly expanded the needs of the City to include all emergency and regular personnel glove needs; and WHEREAS, on February 3, 2009, at the bid opening, six (6) bidders submitted bids, and those bids were tabulated; and WHEREAS, the Purchasing Department is recommending award to various lowest responsive and responsible bidders per bid specifications; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The termination of the Invitation for Bid Contract No. 70054, with the Suppliers, pursuant to Section 2.29, B., "Termination for Convenience", is authorized, and the bids received February 3, 2009, pursuant to Invitation for Bids No. 107067,4, from various lowest responsive and responsible bidders, for the re -procurement of Work and Latex Gloves (including additional gloves not contained in the prior Bid Contract), on a Citywide, as -needed contractual basis, for an initial contract period of two (2) years, with the option to renew for two (2) additional one (1) year periods, are accepted, with funds allocated from the various sources of funds from the user departments and agencies, subject to the availability of funds and budgetary approval at the time of need. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1 } Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
