A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY
FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY
COMMISSION, AFTER DULYADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT IT IS
PRACTICABLE AND MOST ADVANTAGEOUS FOR THE CITY OF MIAMI TO WAIVE
COMPETITIVE SEALED BIDDING PROCEDURES; AUTHORIZING THE
NEGOTIATION AND EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT,
IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE UNIVERSITY OF MIAMI
GORDON CENTER FOR RESEARCH IN MEDICAL EDUCATION, FOR THE
DEPARTMENT OF FIRE -RESCUE, TO CONTINUE, WITHOUT INTERRUPTION,
THE DELIVERY OF THE EMERGENCY RESPONSE TO TERRORISM TRAINING
FOR THE MIAMI URBAN AREA'S FIRST RESPONDERS, INCLUDING EQUIPMENT,
COURSE DELIVERY, OUTCOMES ASSESSMENT AND QUALITY IMPROVEMENT,
EFFECTIVE MARCH 1, 2009, UNTIL THE END OF THE URBAN AREA SECURITY
INITIATIVE ("UASI") 2007, 2008 AND 2009 GRANT, OR UNTIL ALL DELIVERABLES
ARE MET, WITH THE OPTION TO EXTEND FOR TWO (2) ADDITIONAL
ONE-YEAR PERIODS, TO COINCIDE WITH ANY AND ALL THE APPROVED
EXTENSIONS TO ANY OF THE UASI GRANTS, FOR A TOTAL CONTRACT
AMOUNT NOT TO EXCEED $220,000; ALLOCATING FUNDS FROM THE UASI
GRANTS, SUBJECT TO BUDGETARY APPROVAL.
WHEREAS, the City of Miami ("City") has a need for a qualified, professional to continue
without interruption of the delivery of the Emergency Response to Terrorism ("ERT") training for the
Miami Urban Area's first responders; and
WHEREAS, the University of Miami Gordon Center for Research in Medical Education
("UMGCRME") has been chosen to meet the City's requirements for the purpose of providing
Department of Homeland Security, Office of Domestic Preparedness approved training courses for
first responders in the Miami Urban Areas (designated municipal and county employees of the City,
Miami -Dade, Broward and Monroe Counties, jurisdictions within the counties and hospitals within
these jurisdictions) who respond to terrorists and Chemical, Biological, Radiological, Nuclear,
Explosive ("CBRNE") events; and
WHEREAS, the curriculum and methods offered by these courses will provide the Miami
Urban Area's first responders the necessary training and preparation needed to counter CBRNE
incidents, and the ERT training meets the strategic objectives of the Miami Urban Area and will
enhance the City's and the surrounding jurisdictions' ability to respond to a terrorist threat or act; and
WHEREAS, the City Manager has determined that it is advantageous and practical for the City
to continue this partnership with UMGCRME, which provides an important ERT training for the first

responders of the Miami Urban Area in accordance with the Urban Area Security Initiative ("UASI")
Grant Project; and
WHEREAS, UMGCRME has been designated as the lead institution to carry out first
responder anti-terrorist training statewide by the Florida Department of Health; and
WHEREAS, the Florida Division of Emergency Medical Services has certified the course for
continuing education credits and the Florida Department Security Oversight Board, the Florida
Domestic Security State Working Group and the Florida Bureau of Fire Standards and Training have
approved the contents of said ERT Training; and
WHEREAS, the Professional Services Agreement ("Agreement"), attached and incorporated,
will have a commencement date of March 1, 2009, after it is approved by the City Commission and
signed by the City Manager and shall run through the end of the UASI Grant Program 2007, 2008,
and 2009 (subject to budgetary approval), or until all deliverables are met;
NOW THEREFORE, BUT IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City
Manager's finding that it is practicable and most advantageous for the City to waive competitive
sealed bidding procedures, is ratified, approved and confirmed, and the negotiation and execution of
an Agreement, in substantially the attached form, with UMGCRME, for the Department of
Fire -Rescue, to continue, without interruption, the delivery of ERT Training for the Miami Urban Area's
first responders, including equipment, course delivery, outcomes assessment and quality
improvement, effective March 1, 2009, until the end of the UASI 2007, 2008, and 2009 Grant, or until
all deliverables are met, with the option to extend for two (2) additional one-year periods, to coincide
with any and all approved extensions to any UASI Grants, for a total contract amount not to exceed
$220,000, is authorized, with funds allocated from the UASI Grant Program, subject to budgetary
approval.
Section 3. This Resolution shall become effective immediately upon adoption and signature
of the Mayor. {1 }
Footnotes:
{1}If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
