A. REQUEST
Iris Escarra, Esquire, on behalf of 17 Plaza LLC, (the "Applicant"), requests a Special
Appearance to release two (2) Declaration of Restrictive Covenants and one (1) Unity of
Title, for the properties located at 1825 Biscayne Boulevard, 1819 Biscayne Boulevard, 1844
Northeast 4 Avenue, 1840 NE 4 Avenue, 1824 NE 4 Avenue, 1820 NE 4 Avenue, 331 NE 18
Street, and 327 NE 18 Street, Miami, Florida (collectively the "Property").
B. BACKGROUND
On January 24, 1991, pursuant to Resolution No. 91-92 approved a variance (the "1991
Variance") from the City of Miami (the "City") Ordinance No. 9500 (Previous Zoning Code) for
the development of the Chinatown Project at the Property. The 1991 Variance was amended
pursuant to Resolution No. 91-779 and Resolution No. 92-268.

The original property owner, as party to the 1991 Variance, proffered and recorded the
following:
• Declaration of Restrictive Covenants encumbering a portion of the Property,
recorded on August 20, 1992. ("Covenant 1"). Specifically, this entails certain
property in the City of Miami, Florida, legally described as and consisting of All of Lots 3
and 13, Lots 4, 5, 9, and 14, less the West 40.00 feet thereof, and the 10.00 feet alley
lying North of and adjacent to said Lot 5, and the 10.00 feet alley lying South of and
adjacent to said Lot 9, Block 6, "MIRAMAR" ( also known as the "'THIRD AMENDED

MIRAMAR SUBDIVISION a/k/a THIRD AMENDED MAP OF MIRAMAR, according to
the Plat thereof, as recorded in Plat Book 5, Page 4, of the Public Records of Dade
County, Florida
and
All of Lots 3 and 13, Lots 4, 5, 8, 9 and 14, less the West 40.00 feet thereof, and the
10.00 feet alley lying North of the adjacent to said Lot 5, and the 10.00 feet alley laying
South of the adjacent to said Lot 9, Block 6, "MIRAMAR" (also known as the "THIRD

C. THE REASON FOR THE REMOVAL OF THE VARIANCE
As part of the Condition of Approval, the original owner was required to post the $250,000 cash
bond, pay fees due, or obtain approval of a final building permit on or before August 30, 1992,
which was the two (2) year period end date pursuant to the City's Ordinance 9500 (Previous
Zoning Code).
D. RECOMMENDATION
The Planning Department recommends Approval and Full Release of Covenant 1, Covenant
2, and the Unity of Title, based on the facts and findings in this staff report.
E. PROPERTY INFORMATION
The Property is bounded by the following Thoroughfares: to the north — NE 19 Street, east — NE
4 Avenue, south — NE 18 Street, and west — Biscayne Boulevard, and is zoned "T6-36B-O",
Urban Core Transect Zone — Open.

The Covenant Release Committee met on November 27, 2023, and reviewed the request to
release Covenant 1, Covenant 2, and the Unity of Title with newly assigned City -issued ePlan
File ID's:
• PZ-23-17252 1825 BISCAYNE BLVD-Release of Declaration of Restrictive Covenant
(the "PZ-23-17252"): On behalf of 17 Plaza LLC, (the "Owner"), the Applicant
respectfully requests the approval of the Release of Restrictive Covenant Running with
the Land "Release of Covenant" for the property located at 1825 and 1819 Biscayne
Blvd, 1820, 1824, 1840, 1844 NE 4 Avenue and 331 and 327 NE 18 Street, Miami,
Florida all located in the City.
• PZ-23-17282 1825 BISCAYNE BLVD-Release of Declaration of Restrictive Covenant
(the "PZ-23-17282"): On behalf of 17 Plaza LLC, (the "Owner"), we respectfully request
the approval of the Release of Restrictive Covenant Running with the Land "Release of

• PZ-23-17283 1825 BISCAYNE BLVD-Release of Unity of Title (the "PZ-23-17283"): On
behalf of 17 Plaza LLC, (the "Owner"), we respectfully request the approval of the
Release of Unity of Title for the property located at 1825 and 1819 Biscayne Blvd, 1820,
1824, 1840, 1844 NE 4 Avenue and 331 and 327 NE 18 Street, Miami, Florida all
located in the City.
The Covenant Release Committee recommended to the City Commission approval for the
release of Covenant 1, Covenant 2, and Unity of Title with the condition that the Applicant
record the Chinatown Project's Tentative Plat #1380 (the "Tentative Plat") and released
documents simultaneously in the public records of Miami -Dade County, Florida.
H. CONCLUSION
Based upon the analysis herein and the recommendation from the Covenant Release
Committee, the Planning Department recommends Approval with conditions of the request to
release two (2) Declaration of Restrictive Covenants and one (1) Unity of Title.
H. CONDITION
As a condition of this Special Appearance application, ePlan File ID — PZ-22-14439, the
Applicant shall record with the Miami Dade County Recorder the releases of the two (2)
Declaration of Restrictive Covenants and one (1) Unity of Title along with the and Tentative Plat
at the same time.
