A. REQUEST
Pursuant to Chapter 55, Section 55-15 of the City of Miami Code of Ordinances (City Code),
the property owner, 17 Plaza LLC (the "Applicant") requests, through the replatting process, to
vacate and close from public use a 10-foot wide Private Alley (the "Private Alley") that divides
Block 6, Miramar, according to the plat thereof recorded in Plat Book 5, Page 4, of the Public
Records of Miami -Dade County, Florida located at approximately 1825 Biscayne Boulevard,
Miami, FL (the "Property").
RECOMMENDATION
At the May 6, 2021, Plat and Street Committee meeting, the Committee approved one (1)
tentative plat involving a Private Alley. Based on the recommendation of the Plat and Street
Committee and Planning Department staff analysis, the Planning Department recommends
Approval with Conditions.

The Approximate Location of the Private Alley
The location of the Private Alley is generally bounded by Northeast 19 Street to the north,
Northeast 4 Avenue to the east, Northeast 18 Avenue to the south, and Biscayne Boulevard to
the west, please refer to Figure 1.
The Property's MCNP's Future Land Use, MCNP's Overlay designation/Residential Increased
Areas, and Miami 21 Code's Transect Zone
The Property is located within the MCNP's Future Land Use designation - Restricted
Commercial, Residential Density Increased Areas - Omni - 500 Units/Acre, and the Overlay
Areas Urban Central Business District. Finally, the Property is located within Miami 21 Code's
"T6-36B-O", Urban Core Zone — Open, please refer to Figure 2.
Dimensions and Area of a Private Alley
Based on the Applicant's plan drawing - PZD-2, TENTATIVE PLAT, a Private Alley's width is 10
feet in width, the length is 381.15 feet and the area is 3,800.13 square feet, refer to Figure 3.
)urpose of the Tentative Plat - Vacation Closure of a Private Alley
The express purpose of the Tentative Plat is to close, vacate, and abandon from public use a
Private Alley at the Property and to permit future redevelopment of the Property.
Vacation of Right of Way - Expenditures of Funds/Restricted Funds Confirmation
Pursuant to the provisions of Chapter 55, Section 55-15(a) of the City Code, as amended, the
City of Miami Department of Resilience and Public Works and Office of Capital Improvements
(collectively the "Departments") has researched for any City projects involving a Private Alley to
be closed and vacated by the subject Tentative Plat. Both Departments hereby confirm, based

E. FINDINGS
Plat and Street Committee Meeting
Pursuant to Chapter 55, Section 55-15(c) of the City Code, the Plat and Street Committee (the
"Plat and Street Committee") at their May 6, 2021 meeting approved the Applicant's Tentative
Plat involving vacating and closing a portion of a Private Alley from public use. The Plat and
Street Committee considered the following criteria in making their recommendation to the
Planning, Zoning, and Appeals Board:

including public service vehicles such as trash and garbage trucks,

Staff reviewed the Applicant's proposed vacation and closure of a Private Alley based on key
sections of the Miami 21 Zoning Code (Miami 21 Code) and the Miami Comprehensive
Neighborhood Plan (MCNP), and the findings are listed below:

underutilized or abandoned City Right -of -Way.

three hundred and forty (340) feet Frontage length or
more, a cross -Block Passage shall be provided as
follows: If the Frontage Line of a site is at any point more
than three hundred and forty (340) feet from a
Thoroughfare intersection, the Building shall provide a
cross -Block Pedestrian Passage..."

the length of the western side of "Proposed Tract A
(SEVENTEEN PLAZA — TENTATIVE PLAT #1977-A (FIRST

proposed Vacation Closure of the Private Alley, the replatting of
this property and future development will require a cross -Block
Pedestrian passage based on the abovementioned
requirement.

F. CONDITIONS
Based on the facts and findings from the Applicant's Vacation Closure application, the Plat and
Street Committee findings per Chapter 55, Section 55-15(c), and the Planning Department
Staff's findings per the MCNP and Miami 21 Code, the Planning Department recommends
Approval with Conditions of the vacation and closure of a Private Alley from public use as
proposed in the "SEVENTEEN PLAZA — TENTATIVE PLAT #1977-A (FIRST RESUBMITTAL)",
subject to the following conditions:
1. The closure and vacation of a Private Alley shall be developed in accordance with the
"SEVENTEEN PLAZA - TENTATIVE PLAT #1977-A (FIRST RESUBMITTAL)" consisting
of two (2) sheets, digitally signed and sealed by Santiago A. Dominguez, Professional
Surveyor and Mapper, LS No. 6698 State of Florida, dated November 4, 2021.
2. The applicant or their successor shall comply with all conditions and/or comments as
stated in the Plat and Street Letter drafted by Juvenal Santana, P.E., CFM, Supervisor of
Plats - Plat and Street Committee, Director - Public Works, Department of Resilience
and Public Works on May 24, 2021, for the "SEVENTEEN PLAZA - TENTATIVE PLAT
#1977-A (FIRST RESUBMITTAL) LOCATED FROM BISCAYNE BOULEVARD TO NE 4
AVENUE, AND FROM NE 18 STREET TO NE 19 STREET".
3. The Applicant, owner, or successor shall meet applicable development standards
identified in the Miami 21 Code and all applicable local, county, state, and federal
regulations.
4. The Applicant, owner, or their successor shall provide an access plan for review and
acceptance by the City's Fire -Rescue, Police, Solid Waste Departments, and the Capital
Improvements Program/Office Transportation.
5. A building permit, including phased permits, will not be issued on the property being
platted until the final plat is recorded or as authorized by Section 55-10(i) of the City of
Miami Code of Ordinances, as amended.
6. Approval of the requested vacation and closure shall be valid for a period of four (4)
years and shall remain independent of the referenced tentative plat during this period,
pursuant to Section 55-15 of the City of Miami Code of Ordinances, as amended.
7. A Certificate of Occupancy shall only be issued after all the required subdivision
improvements have been completed.
8. The City reserves the right to inspect the site to ensure compliance with the conditions
listed.

The City of Miami Plat and Street Committee, at its meeting of May 6, 2021, APPROVED the above
tentative plat subject to the following revisions being made to the tentative plat, additional information
being provided and/or variances being granted. Please be advised that the processing of your tentative plat
cannot proceed until these conditions and/or comments have been satisfied.
Resilience and Public Works
1. Geometry of boundary has an error of closure of 0.52ft. Measured dimensions are to close.
2. Centerline and Monument Line of NE 4 Avenue and street to the East are depicted at wrong location,
to be corrected. Refer to MAS 23-AA
3. Provide corrections to underground information of existing storm water drainage system adjacent to
proposed plat — underground lines, inlet rim elevation, inlet type, structure bottom elevation, pipe
invert elevation and direction, pipe size, pipe length, exfiltration trench
4. Provide compliance with Bulletin 51 for minimum elevations and other requirements on stormwater
drainage system and inlets.
5. Provide a written confirmation and acceptance by the City Attorney for vacation and closure of the

11. Existing utilities located within the street, alley, and easement to be closed and vacated must be
relocated or easements provided.
12. Provide a legal opinion as to if any claim has been filed prior to July 1, 1972 for reversionary rights
to the Right of Way to be closed and vacated, pursuant to Florida Statutes Chapter 177, Section
177.085(2).
13. Public Hearing/Planning, Zoning and Appeals Board (PZAB).
a. An Opinion of Title as to reversionary rights for the right-of-way to be closed and vacated
will be required by the PZAB. The Opinion of Title must also address whether or not there
are individuals, in addition to the abutting property owners, having an interest in the right-
of-way to be closed and vacated. A copy of the Opinion of Title must be provided to the
Resilience and Public Works Department, prior to acceptance of the application.
b. The PZAB will require a sketch and legal description with a square footage, on an 8 1/2" X
11" paper, for the proposed closure. Contact the Office of the Hearing Boards, at 305-416-
2030. Provide a copy to the Resilience and Public Works Department.
14. Provide a written request to the City of Miami Office of Capital Improvements and Department
of Resilience and Public Works to obtain a Confirmation ("Confirmation"). If the Confirmation
indicates that funds were expended, the City's Finance Department and Office of Management
and Budget will determine the amount of the City's expenditure, specifically including
expenditure of restricted funds (bond funds, grant funds, or otherwise) for such improvements
as a separate line item. The City Manager or his or her designee will issue a Total Expenditure,
which shall specify the amount that the Subdivider must repay to the City ("Total
Expenditure").
Said Confirmation and, if applicable, Total Expenditure must be obtained prior to the
scheduling of a public hearing regarding the vacation and closure before the City Commission,
or before the PZAB for the Alternative Method under the City Code Section 55-15(i) and (j).
Payment to the City of the amount indicated on the Total Expenditure shall be paid to the City
before recordation of the Final Plat in accordance with Section 55-8 of the City Code, or before
scheduling for PZAB consideration for the Alternative Method under the City Code Section 55-
15(i) and (j).
Standard Comments
15. Contact RPW Survey section for additional minor comments.
16. Provide updated tentative plat prior to final plat submittal to be reviewed by Committee members
for compliance to applicable City Codes.
17. Any covenants applicable to the subject property, as required for the Building permit application
and/or as captured in the Opinion of Title submitted prior to Final Plat submittal, will need to be
annotated in the Final Plat.
18. A letter from Comcast is required to determine if any adjustments to their facilities or easements are
required.
19. Verify with Miami -Dade County that the proposed plat name is acceptable.
20. All encroachments across proposed tract and/or lot lines, including any underground
encroachments, must be removed or resolved under all applicable codes prior to final plat submittal.
21. An Opinion of Title, in the City of Miami Opinion of Title form, must be provided at the time of
final plat submittal.
22. Current backup documentation will be required for all who execute the final plat. A resolution for
authority to execute documents and a Certificate of Good Standing from the Secretary of State are
required, if applicable.

23. A plat approval letter from the Florida Department of Transportation (FDOT) is required prior to
final plat submittal. A copy of the final plat must be submitted to the FDOT, not a copy of the
tentative plat.
24. Tentative plat application must be made with Miami -Dade County after receiving approval fromthe
City of Miami Plat and Street Committee. Provide a copy of the notice of action to Resilience and
Public Works.
25. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the
owner's responsibility to work with his/her surveyor and attorney to assure that everything is in
order before submitting the final plat package.
26. Be advised that if all requirements for scheduling the final plat for City Commission action are not
in order, the final plat will not be scheduled for a City Commission meeting.
27. A letter of concurrency from Miami -Dade County School Board is required prior to the final plat
approval (see contact sheet). The tentative plat name and tentative plat number must be included on
the application form.
28. A letter from Miami -Dade Water and Sewer Department is required to release the final plat in
connection with water and sewer service agreements.
29. Provide two 8 1/2" x 11" sketches of the division of the land; one sketch of the existing divisions
before the plat is recorded and one sketch of the divisions after the plat is recorded.
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public rights -
of -way when property is platted. These subdivision improvements include paving, drainage,
landscaping, sidewalks, etc. In some cases, this could represent a substantial investment on your
part. REQUIRED: The submission of an electronic file of the tentative plat, in an AutoCAD, to the
City of Miami Resilience and Public Works Department, Development and Roadway Plans Section
will EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement
letter required for the final plat approval.
2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric,
telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility
easements may be required on the property being platted.
3. A building permit will not be issued on the property being platted until the final plat is recorded or
as authorized by the City of Miami Code Section 55-10(i). Also, the Temporary Certificate
Occupancy and/or Certificate of Occupancy for any building construction will be issued only after
all the required subdivision improvements have been completed.
4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the
issuance of a building permit.
5. In order to mitigate problems associated with access and construction activities throughout the
neighborhood, the contractor/developer is encouraged to notify the affected neighborhoodresidents,
in writing, of the project starting and completion dates at the time of issuance of permits. The
contractor/developer may coordinate the notification of residents with the local City of Miami NET
Service Center.
6. Additional items must be provided to the City of Miami Department of Resilience and Public
Works before the final plat is submitted to the City Commission for approval. You will be notified
in writing as to what these items are. It is required that the applicant contacts the City of Miami
Resilience and Public Works Survey Section to verify that all final plat submittal documents are
