A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING
THE FIRST FINDING OF THE EVALUATION COMMITTEE, PURSUANT TO
REQUEST FOR PROPOSAL 105049, WITH MERCY MEDICAL DEVELOPMENT
D/B/A MERCY OUTPATIENT CENTER, FOR THE PROVISION OF PART I
SERVICES: EMPLOYMENT DRUG SCREENING SERVICES AND ALCOHOL
SCREENING SERVICES FOR GENERAL EMPLOYEES (COLLECTION FACILITY,
DRUG TESTING FACILITY AND MRO SERVICES); PART II SERVICES: SWORN
FIRE DRUG AND ALCOHOL SCREENING SERVICES (COLLECTION FACILITY,
DRUG TESTING FACILITY AND MRO SERVICES); PART IV RANDOM AND
REASONABLE SUSPICION DRUG AND ALCOHOL SCREENING SERVICES FOR
AFSCME, LOCAL 871 EMPLOYEES (COLLECTION FACILITY, DRUG TESTING
FACILITY, AND MRO SERVICES); AND PART V SERVICES: SWORN POLICE
DRUG AND ALCOHOL SCREENING SERVICES (COLLECTION FACILITY, DRUG
TESTING FACILITY, AND MRO SERVICES); AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH MERCY MEDICAL
DEVELOPMENT D/B/A MERCY OUTPATIENT CENTER, FOR A PERIOD OF TWO
(2) YEARS, WITH OPTIONS TO RENEW FOR THREE (3) ADDITIONAL
ONE-YEAR PERIODS, FURTHER ACCEPTING THE RECOMMENDATION OF
THE CITY MANAGER TO APPROVE THE SECOND FINDING OF THE
EVALUATION COMMITTEE TO ACCEPT THE PROPOSAL OF WORK INJURY
SOLUTIONS OF DADE COUNTY INC., D/B/A HEALTH CARE CENTER OF MIAMI,
FOR THE PROVISION OF PART III SERVICES: DOT DRUG AND ALCOHOL
SCREENING SERVICES (COLLECTION FACILITY, DRUG TESTING FACILITY,
AND MRO SERVICES); AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE AN AGREEMENT WITH WORK INJURY SOLUTIONS OF DADE
COUNTY INC., D/B/A HEALTH CARE CENTER, FOR A PERIOD OF TWO (2)
YEARS, WITH OPTIONS TO RENEW FOR THREE (3) ADDITIONAL ONE-YEAR
PERIODS; ALLOCATING FUNDS FROM THE VARIOUS SOURCES OF FUNDS
OF THE USER DEPARTMENTS, SUBJECT TO THE AVAILABILITY OF FUNDS
AND BUDGETARY APPROVAL AT THE TIME OF NEED.
WHEREAS, the City of Miami issued Request for Proposal ("RFP") 105049 for the provision of
Drug Screening Services, five (5) proposals were received, four (4) proposals were responsive and
responsible and one (1) was deemed non-responsive; and
WHEREAS, the Evaluation Committee, appointed by the City Manager, determined that the
Proposals submitted by Mercy Medical Development d/b/a Mercy Outpatient Center and Work Injury
Solutions of Dade County Inc. d/b/a Health Care Center of Miami as responsive to the RFP

requirements; and
WHEREAS, the RFP for drug screening services was divided into the following five parts: Part
I: Employment Drug Screening Services, Part 11: Sworn Fire Drug Screening Services, Part III: DOT
Alcohol and Controlled Substances Testing, Part IV Random and Reasonable Suspicion Drug and
Alcohol Screening Services for AFSCME, Local 871 Employees, Part V: Sworn Police Drug and
Alcohol Screening Services; and
WHEREAS, RFPs were received on September 10, 2008, and the proposals were evaluated
by an Evaluation Committee appointed by the City Manager which recommended that the proposals
received from Mercy Medical Development, d/b/a Mercy Outpatient Center, for Drug Screening
Services ("Services"), Part I Services: Employment Drug Screening Services and Reasonable
Suspicion Drug and Alcohol Screening Services for General Employees (Collection Facility, Drug
Testing Facility and MRO Services): Part II: Services: Sworn Fire Drug and Alcohol Screening
Services (Collection Facility, Drug Testing Facility, and MRO Services); Part IV Random and
Reasonable Suspicion Drug and Alcohol Screening Services for AFSCME, Local 871 Employees
(Collection Facility, Drug Testing Facility and MRO Services); and Part V Services: Sworn Police Drug
and Alcohol Screening Services (Collection Facility, Drug Testing Facility and MRO Services), be
accepted as the proposals most advantageous to the City; and
WHEREAS, RFPs received on September 10, 2008, and the proposals were evaluated by an
Evaluation Committee appointed by the City Manager which recommended that the proposal received
from Work Injury Solutions of Dade County Inc., d/b/a Health Care Center of Miami for the provision of
Drug Screening Services ("Services"), Part III Services: DOT Drug and Alcohol Screening Services
(Collection Facility, Drug Testing Facility and MRO Services), be accepted as the proposals most
advantageous to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The recommendation of the of the City Manager to approve the first finding of the
Evaluation Committee to accept the proposal of Mercy Medical Development, d/b/a Mercy Outpatient
Center pursuant to RFP No. 105049, to perform Drug Screening Services (Part I: Employment Drug
Screening Services and Reason Suspicion Drug and Alcohol Screening Services Part II: Sworn Fire
Drug and Alcohol Screening Services, Part IV Random and Reasonable Suspicion Drug and Alcohol
Screening Services, Part V: Sworn Police Drug and Alcohol Screening Services), for designated
personnel for Employee Relations, is accepted.
Section 3. The City Manager is authorized {1} to negotiate and execute an Agreement(s), in
substantially the attached form(s), with Mercy Medical Development d/b/a Mercy Outpatient Center for
a period of two (2) years, with options to renew for three (3) additional one-year periods, with funds
allocated from the various sources of funds and budgetary approval at the time of need.
Section 4. The recommendation of the City Manager to approve the second finding of the
Evaluation Committee to accept the proposal of Work Injury Solutions of Dade County Inc., d/b/a
Health Care Center of Miami for Part I II: DOT Drug and Alcohol Screening Services (A. Collection

Facility, B. Drug Testing Facility. and C. MRO Services); for the Department of Employee Relations, is
accepted.
Section 5. The City Manager is authorized {1} to negotiate and execute an Agreement, in
substantially the attached form, with Work Injury Solutions of Dade County Inc., d/b/a Health Care
Center of Miami for a period of hvo (2) years, with options to renew for three (3) additional one-year
periods, with funds allocated from the various sources of funds and budgetary approval at the time of
need.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that maybe
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
