The waiver will enable the City to spend 97 percent of its FY2007 Emergency Shelter Grants Program funds on outreach and assessment and referral services for its homeless population. The McKinnw-Vento Homeless Assistance Act provides that the 30 percent limitation on esser,tial services in 42 USC 11374(a)(2)(B) may be waived under 42 -USC1.1374(b), if the grantee "demonstrates that the other eligible activities under the program are already being carried out in the locality with other resources." On January 16, 2008, General Deputy Assistant Secretary for Community Planning and Development, Nelson Bregon, waived the 30 percent essential service cap. This action enables the City to expend $353,520 of its FY2007 ESG grant on essential supportive services. The City should be reminded that the regulations at 24 CFR 576.35(b) states that ESG funds need to be spent within 24 months from the date of grant award.
