PERPETUAL EASEMENT
THIS EASEMENT made the day of , 20 , by THE CITY OF
MIAMI, a municipality of the State of Florida, Grantor, to the STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION, Grantee.
WITNESSETH: That the Grantor for and in consideration of the sum of One Dollar and other
valuable considerations paid, the receipt and sufficiency of which is hereby acknowledged, hereby grants unto
the Grantee, a perpetual easement for the purpose of constructing and maintaining a School Flasher Mast
Arm in, over, under, upon and through the following described land in Miami -Dade County, Florida:
Parcel 800 FIN No. 4144771
A portion of lot 5 Block K, RIVERVIEW according to the Plat thereof as recorded in Plat Book 5 at
Page 43 of the Public Records of Miami -Dade County, Florida: being in the Southeast '/ of Section 2,
Township 54 South, Range 41 East, Miami -Dade County, Florida: being more particularly described as
follows:
Commence at the intersection of the East line of Lot One and a line 10.00 feet South and Parallel with
e North line of Lot One, Block K of said Riverview, said line being the existing Right of Way Line of State
)ad 968 (local name SW First Street and Thirteenth Street as per Plat) as shown in Florida Department of
nsportation Maintenance Map Section 87053-001 and as recorded in Road Plat Book 152 at Page 16 of the

rHE EVENT that the Grantee at any time after commencement of operation of the Project
Project, or if the City Manager determines that the easement is needed for a municipal purpose,

The Grantee accepts the Perpetual Easement "as -is", in its present condition and state of repair and
without any representation on or behalf of the Grantor, and agrees that the Grantor shall under no
circumstances, be liable for any latent, patent or other defects in the easement area. Grantee at its sole cost,
shall maintain the easement area in good order and repair at all times and in an attractive, clean, safe and
sanitary condition and shall suffer no waste or injury thereto. Grantee shall repair to its original, or better,
condition and be responsible for all repairs to the easement area, including the driveway, required or caused by
the Grantee's use of any part thereof.
IN WITNESS WHEREOF, the said Grantor has caused these presents to be executed in its name by its
City Manager, and its seal to be hereto affixed, attested by its City Clerk, the date first above written.
