Dear Ladies and Gentlemen: ADD Inc is the architect of recor=d for Live Nation Worldwide, Inc. and the proposed Bayfront Park Amphitheater Renovation (Project). We respectfully request that the City Commission of the City of Miami approve and adopt the resolution justifying the waiver of competitive procurement procedures in the selection of HITT Contracting, Inc., as the contractor providing the additional services required by the City of Miami Building Department pursuant to the Management Agreement (Agreement) between the City of Miami (City), the Bayfront Park Management Trust (Trust) and Live Nation Worldwide, Inc., (Live Nation) for the management and operation of the Bayfront Park Amphitheater. Specifically; additional restroom capacity, a generator, site lighting and a fire alarm system ("Amphitheater Improvements") Waiving the bid process for the Amphitheater Improvements is in the best interest of the City of Miami and the Project for the following reasons: I.) HITT's relationship with Live Nation started with the renovation of the Fillmore Miami Beach at the Jackie Gleason Theater, completed in. 2007. For the Project, HITT was selected by Live Nation at its inception to offer pre -construction services. They have been present at all the weekly project meetings, offering construction and pricing advice throughout the Project's design development, construction documentation, and pricing phases. 2.) During the course of the Project's development, the City of Miami Building Department required the Amphitheater Improvements to be built in order to comply with building codes. Live Nation had originally intended to use day -of -event temporary bathrooms to augment the existing on- site bathrooms. The City of Miami Building Department required providing permanent bathroom structures as a condition to obtaining a building permit and a certificate of completion. 3.) The Amphitheater Improvements have increased the Project's total costs beyond $2,700,000. The Trust has agreed to pay up to $500,000, to be used towards the costs of the Amphitheater Improvements. Live Nation will be responsible for covering any excess costs above the $2,000,000 cap. ITEM-L3UN U -a -o . In the best interest of the City of Miami and the Bayfront Park Management Trust, having one firm managing the Project, including the Amphitheater Improvements, should mitigate any miscommunication and potential delays during construction. 5.) Through its involvement with the Project, HITT has familiarized themselves with the procedures and requirements established by the City of Miami, thus providing greater assurance that those procedures and requirements will be uniformly enforced and followed. For these reasons, we recommend that the City Commission of the City of Miami adopt the resolution waiving the bidding process for the Amphitheater Improvements and allow HITT Contracting, Inc. to continue and complete the renovation of the Bayfront Park Amphitheater in a timely manner benefiting the City of Miami and the Bayfront Park Management Trust.
