HomeMy WebLinkAboutLegislationFile Number: 09-00313 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT FUNDS AND EXECUTE ALL NECESSARY LOCAL AGENCY PARTICIPATION ("LAP") AGREEMENTS, FOR ALL FEDERAL GRANTS AWARDED AS PART OF THE FEDERAL STIMULUS PACKAGE FOR TRANSPORTATION PROJECTS; CURRENTLY CONSISTING OF $1,028,428 FOR THE PUBLIC WORKS CITYWIDE ADA SIDEWALK IMPROVEMENTS PROJECT, $1,713,201 FOR THE CAPITAL IMPROVEMENTS BRICKELL KEY BRIDGE PROJECT, B-30634, $6,470,966 FOR THE CAPITAL IMPROVEMENTS NE 2ND AVENUE IMPROVEMENTS PROJECT, B-78508, AND $1,483,900 FOR THE MIAMI RIVER GREENWAY SW 1ST COURT TO S. MIAMI AVE. PROJECT, B-30130, IN SUBSTANTIALLY THE ATTACHED FORM, TO IMPLEMENT ACCEPTANCE OF SAID CONTRIBUTION OF FUNDS, WITH PROJECTS AND AMOUNTS SUBJECT TO CHANGE AND FUNDS TO BE APPROPRIATED BY SEPARATE RESOLUTION(S). WHEREAS, the City of Miami ("City") applied for and was awarded federal grants as part of the federal stimulus package for transportation projects; and, WHEREAS, the Florida Department of Transportation ("FDOT") will serve as the pass through for the federal funds and requires LAP agreements with FDOT will be required in various amounts in order to access the funding awards; and, WHEREAS, the final list of projects and exact amounts have yet to be approved; and, WHEREAS, in consideration of the short timeframe allotted to provide FDOT with the necessary documents to obligate the federal funds, the City Manager requests authority to accept funds and execute the necessary LAP agreements for all stimulus projects in the final, federally -approved funding amounts; and, WHEREAS, this resolution is necessary in order to meet FDOT's deadline requiring signed LAP agreements along with project documentation by April 17th; and, WHEREAS, all LAPs executed pursuant to this resolution and final award amounts will be subsequently reported back to City Commissioners by the City Manager; and, WHEREAS, currently, we expect the awards to consist of $1,028,428 for the PW Citywide ADA Sidewalk Improvements Project, $1,713,201 for the CIP Brickell Key Bridge Project, B-30634, $6,470,966 for the CIP NE 2nd Avenue Improvements Project, B-78508, and $1,483,900 for the CIP Miami River Greenway SW 1st Court to S. Miami Ave. Project, B-30130 ; however, additional projects may be added and funding amounts are subject to change; and, City of Miami Page 1 of 2 Printed On: 3/18/2009 File Number.' 09-00313 WHEREAS, this resolution authorizes the City Manager to accept funds and execute all necessary LAP agreements required for the City to receive the funding; and, WHEREAS, FDOT funds will be appropriated by separate resolution(s); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings found in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized fl) to accept funds and execute all necessary Local Agency Participation ("LAP") agreements, for all federal grants awarded as part of the federal stimulus package for transportation projects, currently consisting of $1,028,428 for the PW Citywide ADA Sidewalk Improvements Project, $1,713,201 for the CIP Brickell Key Bridge Project, B-30634, $6,470,966 for the CIP NE 2nd Avenue Improvements Project, B-78508, and $1,483,900 for the CIP Miami River Greenway SW 1st Court to S. Miami Ave. Project, B-30130, in substantially the attached form, to implement acceptance of said contribution of funds, with approved projects and amounts subject to change and funds to be appropriated by separate resolution(s). Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2) APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
