A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S RECOMMENDATIONS AND FINDINGS THAT COMPETITIVE
NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR
ADVANTAGEOUS PURSUANT TO SECTION 18-86(A) (3)(C) OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS
FOR SAID PROCEDURES; APPROVING THE RECOMMENDATIONS AND
FINDINGS OF THE CITY OF MIAMI'S DEPARTMENT OF PARKS AND
RECREATION THAT AMIGOS TOGETHER FOR KIDS, INC. A/K/A AMIGOS FOR
KIDS, A FLORIDA NOT-FOR-PROFIT CORPORATION, IS THE MOST QUALIFIED
FIRM TO PROVIDE LITERACY INSTRUCTION, TEACHER SUPERVISION,
COMPUTER TECHNOLOGY ACTIVITIES, FAMILY DAY, AND OTHER SUCH
ACTIVITIES IN CONJUNCTION WITH EDUCATIONAL AND PARK SERVICES AT
JOSE MARTI PARK; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANIALLY
THE ATTACHED FORM, WITH AMIGOS TOGETHER FOR KIDS, INC. A/K/A
AMIGOS FOR KIDS, FOR A PERIOD COMMENCING AUGUST 1, 2008 THROUGH
JUNE 5, 2009, IN AN AMOUNT NOT TO EXCEED NINETY THOUSAND DOLLARS
($90,000), WITH THE OPTION TO RENEW FOR TWO (2) ADDITIONAL SIMILAR
PERIODS FOR THE SAME NOT TO EXCEED AMOUNT; FROM ACCOUNT
11550.295999.531000.0.0, WITH THE FUTURE FISCAL YEARS' FUNDING
SUBJECT ONLY TO BUDGETARY APPROVAL.
WHEREAS, the City of Miami's ("City's") Department of Parks and Recreation applied for a
Children's Trust grant to enhance the quality of after-school programming provided in seven of the
City's parks; and
WHEREAS, the City was awarded the Out -Of -School, "Heart of Our Parks" Children's Trust grant
in the amount of Six Hundred and Sixty -Five Thousand, Six Hundred and Forty Six Dollars ($665,646);
and
WHEREAS, the contract with the Children's Trust is being entered into by the City, and Amigos
Together for Kids, Inc. a/k/a Amigos for Kids was determined to be the most advantageous
not-for-profit organization and in the City's best interests to provide said literacy instruction, teacher
supervision, computer technology activities, family day, and other such activities at Jose Marti Park;
and
WHEREAS, the City Manager has approved the recommendations of the Department of Parks and
Recreation, and has made findings that pursuant to Section 18-86(a)(3)(c) of the Code of the City of
Miami, Florida, as amended ("City Code"), competitive negotiation methods are not practicable or
advantageous for obtaining said services, and has recommended to the City Commission that the

WHEREAS, the City Manager and the Department of Parks and Recreation are requesting for the
City Commission to authorize the City Manager to negotiate and to execute a Professional Services
Agreement ("Agreement"), in substantially the attached form, with Amigos Together for Kids, Inc. a/k/a
Amigos for Kids, for an amount not to exceed Ninety Thousand Dollars ($90,000), for the period from
August 1, 2008 through June 5, 2009 with the option to.extend for two (2) additional similar periods for
the same not to exceed amount; and
WHEREAS, the City Manager and the Department of Parks and Recreation are requesting the
appropriation of said Children's Trust funding for this Agreement, in the grand total amount not to
exceed Ninety Thousand Dollars ($90,000), for the initial Fiscal Year 2008-2009, with future Fiscal
Year funding subject only to budgetary approval;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporate as it fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City
Manager's findings and recommendations that competitive negotiation methods and procedures are
not practicable or advantageous pursuant to Section 18-86(a)(3)(c) of the City Code, waiving the
requirements for said procedures, is ratified, approved and confirmed and the City Department of
Parks and Recreation's recommendations and findings that Amigos Together for Kids, Inc. a/k/a
Amigos for Kids, a Florida Not -For -Profit Corporation, is the most qualified firm to provide literacy
instruction, teacher supervision and other such activities at Jose Marti Park, is approved.
Section 3. The City Manager is authorized {1} to negotiate and to execute an Agreement, in
substantially the attached form, with Amigos Together for Kids, Inc. a/k/a Amigos for Kids, for a period
commencing August 1, 2008 through June 5, 2009, in an amount not to exceed Ninety Thousand
Dollars ($90,000), with the option to renew for two (2) additional similar periods at the same not to
exceed amount; from account 11550.295999.531000.0.0 with future Fiscal Year's funding, subject
only to budgetary approval.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
