Subject: Florida Inland Navigation District (FIND) Grant Application for the Kennedy Park Shoreline
Stabilization Project - Phase I
Purpose of Item:
The Department of Parks and Recreation seeks City Commission authorization to apply for $40,000 in
grant funding from the Florida Inland Navigation District (FIND) for design and permitting for the
Kennedy Park Shoreline Stabilization Project - Phase I. The total estimated cost of this phase of the
project is not to exceed $80,000. The City would provide $40,000 in matching funding from the
account identified below.
Background Information:
Shoreline restoration is necessary to return the tidal flow to the mangroves along the shoreline of
Kennedy Park in Coconut Grove. Shoreline stabilization will allow greater public access to the water
from the upland and bring a tremendous public benefit to a highly used park located on Biscayne Bay
and the Atlantic Intracoastal Waterway.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR GRANT
FUNDING TO THE FLORIDA INLAND NAVIGATION DISTRICT ("FIND") WATERWAYS
ASSISTANCE PROGRAM, IN SUBSTANTIALLY THE ATTACHED FORM, IN AN
AMOUNT NOT TO EXCEED $80,000, FOR THE KENNEDY PARK SHORELINE
STABILIZATION - PHASE I PROJECT ("PROJECT"); AUTHORIZING THE
ALLOCATION OF THE REQUIRED MATCHING FUNDS FOR FIFTY PERCENT (50%)
OF THE PROJECT COSTS, IN AN AMOUNT NOT TO EXCEED $40,000, TO BE
PROVIDED BY THE PARKS SPECIAL REVENUE FUND B-30541; AUTHORIZING THE
CITY MANAGER TO EXECUTE ANY OTHER NECESSARY DOCUMENTS FOR THE
SUBMISSION OF SAID GRANT APPLICATION FOR FISCAL YEAR 2009-2010.

WHEREAS, the City of Miami ("City") wishes to restore the shoreline and restore
tidal flow to the mangroves by making a design and applying for Phase I permitting
("Project'); and
WHEREAS, the total cost of the Project is estimated not to exceed $80,000; and
WHEREAS, the City wishes to apply for grant funding from the Florida Inland
Navigation District ("FIND") in the amount of $40,000 or fifty (50%) of the total Project
cost; and
WHEREAS, the City is allocating the matching funds of $40,000 or (50%) of the
total cost from the Parks SPECIAL REVENUE FUND B-30541; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Resolution are adopted by reference and incorporated as if fully set forth in this
Section.
Section 2. The City Manager is authorized {1} to submit an application for grant
funding to FIND Waterways Assistance Program, in substantially the attached form, in
an amount not to exceed $300,000 for the Project, and execute the necessary
documents required by FIND, including the Program Agreement, all as are attached
hereto, to implement this Resolution.
Section 3. The City of Miami further certifies to FIND the following matters:
(1) The City accepts the terms and conditions set forth in FIND Rule 666-2 F.A.C.,
which outlines the Waterways Assistance Program and which will be a part of
the Project Agreement for any assistance under this proposal;
(2) The City is in complete accord with the proposal and agrees to carry out the
program in the manner described in the proposal and any plan and
specifications attached thereto; unless prior approval for any change has need
received from FIND;
(3) The City has the ability and intention to finance its share of the cost of the
Project and that the Project will be operated and maintained at the expense of
the City for public use;
(4) The City will not unlawfully discriminate against any person on basis of race,
color or national origin in the use of any property or facility acquired or
developed pursuant to this proposal, and shall comply with the terms and intent
of the Title VI of the Civil rights Act of 1964, P.L. 88-352 (1964) and design and
construct all facilities to comply fully with statutes relating to accessibility by
handicapped persons as well as other federal, state and local laws, rules and
requirements;
(5) The City agrees to maintain adequate financial records for the proposed Project
to substantiate claims for reimbursements; and
(6) The City will make available to FIND, if requested, a post -audit of expenses
incurred on the Project prior to, or in conjunction with, request for the final (10%)
of the funding agreed to by FIND.
Section 4. The allocation of required matching funds, in an amount not to exceed
$150,000 from Parks Fund B-30541; and
Section 5. This Resolution shall become effective immediately upon its adoption
and signature of the IVlayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that
may be imposed by the City Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of
ten calendar. days from the date it was passed and adopted. If the Mayor vetoes this
Resolution, it shall become effective immediately upon override of the veto by the City
Commission.

WHEREAS, THE City of Miami

The City of Miami seeks to stabilize the shoreline along Kennedy Park in Coconut Grove to

AND, Florida Inland Navigation District financial assistance is required for the program
mentioned above,
NOW THEREFORE, be it resolved by the City of Miami

make application to the Florida Inland Navigation District in the amount of 50 % of the
actual cost of the project in behalf of said City of Miami

that it certifies to the f6llowing:
That it will accept the terms and conditions set forth in FIND Rule 6613-2
F.A.C. and which will be a part of the Project Agreement for. any assistance awarded under
the attached proposal.
2. That it is in complete accord with the attached proposal and that it will carry out
the Program in the manner described in the proposal and any plans and specifications attached
thereto unless prior approval for any change has been received from the District.
