Subject: Waiver of Competitive Bidding regarding_the Selection of Contractor for Public Infrastructure
Work Related to the proposed Marlins Baseball Stadium
Purpose of Item:
It is respectfully recommended that the City Commission approve the attached resolution, by a four-
fifths (4/5) affirmative vote, waiving competitive sealed bidding for the Public Infrastructure work
associated with the proposed Martins Baseball Stadium, awarding the Public Infrastructure work to
Hunt/Moss, a Joint Venture Construction Manager/General Contractor.

Background Information (continued):
On March 3, 2008 the City Commission authorized the City Manager to execute the "Baseball
Stadium Agreement" (BSA) among the City of Miami, Miami -Dade County, and Florida Marlins,
L.P. The BSA outlined the general terms under which the parties would move forward to design,
develop, construct, and operate a Major League Baseball stadium and related Parking Facilities on the
former Orange Bowl Site. One of the initial undertakings that must occur relative to the proposed
Baseball Stadium is the construction of water lines, sanitary and storm sewer services; gas utilities;
electricity infrastructure; telecommunications; road work, lighting, and resurfacing; sidewalks, curbs
and gutters; traffic signalization; utility relocation and related work (the Public Infrastructure Work")
which are necessary to support the Baseball Stadium..
The selection of a contractor to complete the Public Infrastructure Work, estimated to cost
$24,000,000 requires competitive sealed bidding. However, Section 18-85 (a) of the City of Miami
City Code allows and expressly provides for a waiver of competitive sealed bidding by a 4/5tH vote of
the City Conunission in cases where the City Manager has made written findings and presented these
findings to the City Commission, advising that competitive sealed bidding should be waived in a
particular instance as it is not practicable or advantageous to the City. In this instance, the City
Manager has determined that competitive sealed bidding is not practicable or advantageous for the
City (attached) because the Stadium Developer will contract with Hunt/Moss to perform construction
management and general contracting services for the Baseball Stadium, allowing Hunt/Moss to be
situated on site throughout the development of the proposed Baseball Stadium. Contracting with
Hunt/Moss to undertake the construction management and general contracting services for the Public
Infrastructure Work would serve the best interest and be advantageous to the City, as their
involvement would facilitate a more coordinated project, thereby drastically reducing the potential for
cost overruns. In addition, Hunt/Moss' management would provide for increased standards in
consistency of workmanship, priority of use of areas for construction, efficiency in project staffing
and coordination of procurement timing and strategy.
