ENCLOSURES:
Pursuant to Resolution No. 03-1105, adopted on October 23, 2003, the City Commission authorized
a Memorandum of Understanding between the City and City of Miami Retired Police Officers
Community Benevolent Association, Inc. ("COMRPOCBA") and the City's Department of Capital
Improvements Projects agreed to oversee the remaining work for the above referenced Project, a
cooperative effort to restore the Black Courthouse and Police Precincts as a police museum.
COMRPOCBA originally entered into an agreement with R.J. Heisenbottle Architects, P.A. for
Architectural services required for each phase of the Project. The Capital Improvements Program,
upon assuming project management responsibilities, also required architectural services for the
Project. At that time, the City and R.J. Heisenbottle had an active miscellaneous architectural
services agreement, pursuant to Resolution No. 02-144, adopted on February 14, 2002. In the
interest of maintaining continuity of work, Commission approval was sought to engage the firm under
this agreement to continue providing services for the Project, approved pursuant to R-04-0024.
Beyond the term of the architectural agreement, further construction administration services in the
amount of $43,1478.02, were required by the City during the construction of the project. Funding for
the additional services is available from Capital Improvement Project ("CIP") No. B-30299.
FINDING
In the interest of maintaining continuity of work, it has been determined by the CIP that using another
consultant to perform the remaining construction administration services required for the project
would have considerably delayed closure and ultimately cost the City undue additional expenditures.
CIP found that it was most practicable and advantageous to the City for R.J. Heisenbottle Architects,
P.A., to perform all necessary architectural services for the project, including the remaining
construction administration services.
We recommend that the City Manager concur to waive the formal requirements set forth in the Code
of the City of Miami, as amended in sections 18-87, 18-90 and under Florida Statutes Section
287.055 and affirm, adopt these findings and forward the matter to the City Commission for its
approval.
