A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT THE CONVEYANCE FROM
MOVERS, INC. ("MOVERS") OF THE PROPERTIES REFERRED TO AS THE LIFE
QUEST FACILITIES, LOCATED AT 1301 NORTHEAST 111TH STREET, 11115
NORTHEAST 13TH AVENUE, 1075 NORTHEAST 149TH STREET, 1095-1097
NORTHEAST 149TH STREET AND 14950-52 NORTHEAST 11TH AVENUE,
MIAMI FLORIDA, AS DESCRIBED IN EXHIBIT "A", ATTACHED AND
INCORPORATED; AUTHORIZING THE DE -OBLIGATION OF UNSPENT
HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA") FUNDS, IN
THE TOTAL AMOUNT OF $198,792.35, AS SPECIFIED IN EXHIBIT "B",
ATTACHED AND INCORPORATED; FURTHER AUTHORIZING THE CITY
MANAGER TO DEMAND FROM MOVERS THE REPAYMENT OF ALL
DISBURSED HOPWA FUNDS, IN THE AMOUNT OF $181,207.65, AND TO TAKE
SUCH ADDITIONAL ACTION TO RECOVER SUCH FUNDS FROM MOVERS AS
MAY BE APPROVED BY THE CITY ATTORNEY; AUTHORIZING THE CITY
MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR SAID
PURPOSE(S).
WHEREAS, pursuant to Resolution No. 93-769, adopted December 16, 1993, the Miami City
Commission awarded Housing Opportunities for Persons with Aids ("HOPWA") funds, in the amount of
$1,433,392.00, to Lock Towns Community Mental Health Center, Inc. ("Lock Towns") to acquire,
rehabilitate and operate eighteen (18) units of rental housing for low income persons with AIDS at the
Life Quest facilities located at 1301 Northeast 111th Street, 11115 Northeast 13th Avenue, 1075
Northeast 149th Street, 1095-1097 Northeast 149th Street and 14950-52 Northeast 11th Avenue,
Miami, Florida; and
WHEREAS, pursuant to Resolution No. 03-1244, adopted December 18, 2003, the Miami City
Commission approved the transfer of the properties from Lock Towns to Movers, Inc. ("Movers"), and
awarded two hundred and fifty thousand dollars ($250,000) from the City of Miami's ("City")
Department of Community Development/ Emergency Program to Movers for the rehabilitation and
operation of the Life Quest facilities; and
WHEREAS, on December 30, 2003, Lock Towns transferred the properties comprising the Life
Quest facilities (the "Properties") to Movers; and
WHEREAS, pursuant to Resolution No. 04-0445, adopted July 8, 2004, the Miami City
Commission authorized the transfer of HOPWA funds, in the amount of $100,000, from Movers for
operating support programs to Movers for the rehabilitation of the Life Quest I and II facilities; and
WHEREAS, pursuant to Resolution No. 05-0238, adopted April 14, 2005, the Miami City
Commission allocated an additional one hundred thirty thousand dollars ($130,000) to Movers for the
rehabilitation of the Life Quest facilities; and

WHEREAS, Movers has expended one hundred eighty-one thousand two hundred seven dollars
and sixty five cents ($181,207.65) for the rehabilitation of the Life Quest facilities; and
WHEREAS, due to financial issues affecting Movers, the project is currently at a standstill and in
disrepair with county liens being placed on the project; and
WHEREAS, Movers has decided to return the Properties to the City; and
WHEREAS, the Administration recommends the following:
1. The City accept the conveyance of the Properties from Movers, and
2. The City de -obligate the remaining unspent HOPWA funds in the amount of one hundred
ninety-eight thousand seven hundred ninety-two dollars and thirty-five cents ($198,792.35), and
3. The City demand the repayment of all HOPWA funds disbursed to Movers for the Life Quest
facilities, in the total amount of one hundred eighty-one thousand two hundred seven dollars
and sixty five cents ($181,207.65), and authorize the City Manager to take such further action
to recover such funds from Movers as may be approved by the City Attorney;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized(1} to accept the conveyance from Movers of the
Properties referred to as the Life Quest facilities, located at 1301 Northeast 111th Street, 11115
Northeast 13th Avenue, 1075 Northeast 149th Street, 1095-1097 Northeast 149th Street and 14950-
52 Northeast 11th Avenue, Miami Florida, described in Exhibit "A", attached and incorporated.
Section 3. The de -obligation of remaining unspent HOPWA funds allocated to Movers for the
rehabilitation of the Life Quest facilities, in the total amount of $198,792.35, is authorized.
Section 4. The City Manager is authorized(1} to demand repayment from Movers of all disbursed
HOPWA funds for said Properties, in the amount of $181,207.65, and to take such additional action to
recover such funds from Movers as may be approved by the City Attorney.
Section 5. The City Manager is authorized (1} to execute all necessary documents for said
purpose(s).
Section 6. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.(2)

{1 } The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
