A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE BID RECEIVED DECEMBER 30, 2008, PURSUANT TO
INVITATION FOR BIDS NO. 08-09-016, FROM MEF CONSTRUCTION, INC., IN
ACCORDANCE WITH THE LOCAL PREFERENCE OPTION IN SECTION 18-89(B)
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, FOR THE
PROJECT ENTITLED "DISTRICT 5 -SIDEWALK REPAIR, PROJECT IV, B -30377E,"
FOR A ONE (1) YEAR PERIOD, IN AN ANNUAL AMOUNT NOT TO EXCEED
$57,990, TOTAL BID, AS STATED ON THE FORMAL BID DOCUMENT AND THE
DEPARTMENT OF PUBLIC WORKS PROJECT FACT SHEET, ATTACHED AND
INCORPORATED, WITH THE OPTION TO RENEW FOR UP TO FOUR (4)
ADDITIONAL ONE (1) YEAR PERIODS, 1N AN ANNUAL AMOUNT NOT TO
EXCEED $57,990; ALLOCATING SAID FUNDS, FROM CAPITAL IMPROVEMENT
ACCOUNT NO. 341330; AUTHORIZING THE CITY MANAGER TO EXECUTE A
CONTRACT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PROJECT;
FURTHER AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
EXECUTE SAID OPTIONS TO RENEW, SUBJECT TO THE AVAILABILITY OF
FUNDING AND THE CONTRACTOR'S PERFORMANCE.
WHEREAS, on December 30, 2008, the City Clerk accepted formal bid No. 08-09-015 for the
project entitled "District 5 - Sidewalk Repair, Project IV, B -30377E;" and
WHEREAS, Maggolc, Inc., a non -local bidder, submitted the lowest responsive and responsible bid
in the amount of $57,990; and
WHEREAS, MEF Construction, Inc., a local bidder, submitted a bid in the amount of $63,200; and
WHEREAS, Section 18-89(b) of the Code of the City of Miami, Florida, as amended ("City Code"),
states that if the amount of a bid submitted by a bidder who maintains a local office is not more than
ten percent (10%) in excess of the lowest other responsive and responsible bidder, such local bidder
may be offered the opportunity of accepting the contract at the low bid amount; and
WHEREAS, MEF Construction, Inc., a local bidder, submitted a bid that was less than ten percent
(10%) in excess of the lowest responsive and responsible bidder, and has agreed to accept the
contract at the low bid amount of $57,990;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The bid received December 30, 2008, pursuant to Invitation for Bids No. 08-09-016,
from MEF Construction, Inc., in accordance with the local preference option in Section 18-89(b) of the

FLORIDA:
Section 1. The bid received December 30, 2008, pursuant to Invitation for Bids No. 08-09-016,
from MEF Construction, Inc., in accordance with the local preference option in Section 18-89(b) of the

City Code, for the project entitled "District 5 -Sidewalk Repair, Project IV, B -30377E," for a one (1) year
period, in an annual amount not to exceed $57,990, total bid, as stated on the formal bid document
and the Department of Public Works Project Fact Sheet, attached and incorporated, with the option to
renew for up to four (4) additional one (1) year periods, in an annual amount not to exceed $57,990, is
accepted, with funds allocated from Capital Improvements Account No. 341330.
Section 2. The City Manager is authorized {1} to execute a Contract, in substantially the attached
form, for said project.
Section 3. The City Manager or his Designee is further authorized {1} to execute said options to
renew subject to the availability of funding and the contractor's performance.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
(1) The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
