LEGAL DESCRIPTION See supporting documentation. PETITION An Ordinance of the Miami City Commission amending Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, by amending Article 9 Section 916 Interim Parking, in order to remove the sunset provision of this section, add a new form of interim parking, provide for new criteria and special permit requirements, and allow for time extensions with referrals and containing a repealer provision and a severability clause; and providing for an effective date. PLANNING RECOMMENDATION APPROVAL BACKGROUND AND ANALYSIS PLANNING ADVISORY BOARD CITY COMMISSION This ordinance will allow for the continuation of interim parking facilities by special permit with new requirements that will ensure compliance with minimum parking lot standards over a period of 5 years. This provision of the code had previously been sunset and the result has been a number of facilities with code compliance issues. The removal of the sunset provision with new standards will allow this important function to continue legally while assuring compliance over time. INTERIM PARKING, IN ORDER TO REMOVE THE SUNSET PROVISION OF THIS SECTION, ADD NEW FORM OF INTERIM PARKING, PROVIDE FOR NEW CRITERIA AND SPECIAL PERMIT REQUIREMENTS, AND ALLOW FOR THE TIME EXTENSIONS WITH REFERALS; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board (PAB) considered this item at its December 3, 2008 meeting, Item No. P.1 adopted Resolution No. PAB and by a vote of _to_ has recommended the adoption of this item to the City of Miami City Commission; and WHEREAS, the City Commission, after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its citizens to amend its Zoning Ordinance as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows: "Sec. 916. Interim parking. 916.1. Intent. It is intended that this section allow for a mechanism which will enable conditionally, unimproved and partially improved lots in the city to be utilized, for accessory parking purposes in a temporary fashion or as a component of facilities which require parking on an event by event basis, without having to pave comply with permanent parking requirements on the proposed interim lots to accomplish this goal. As specified herein, proposals subject to this section shall also ensure that safety measures are implemented which will safeguard users of the subject facilities. 916.2. Special permit required for approval. An interim parking facility shall be defined as a surface parking lot for which paving, drainage and marking of parking spaces as well as other improvements incidental to permanent parking lots City of Miami Page I of 4 Printed On: 1112112008 File Number: 08-01419zt shall not be required. There shall be twe (2) three 3 types of interim parking as follows: (a) Temporary special event parking, and (b) Short-term event parking—And (c) Interim special use parking. 916.2.1. Temporary special event parking. Temporary special event parking on unimproved interim parking lots, as defined herein, shall only be permitted pursuant to Class I Special Permit and only in conjunction with an approved special event that requires the additional parking to be accommodated on said lot(s). 916.2.2. Short-term event parking facilities. Short-term event parking facilities shall be permitted as a conditional use on non -residentially zoned lots, within a six hupd-red- (600) one thousand (1000) foot radius of the major public facility they are intended to serve, pursuant to a Class II Special Permit subject to the applicable criteria in Section 1305, or A- duratie.p ^f ^^ Fpe.re than GRe yeaF, and only in conjunction with major public facilities such as major sports facilities, arenas, exhibition centers, performing arts centers and any other such major public facility whose scale and operation warrant the use of interim parking facilities on an event -by -event basis versus daily year-round use. a sn�ea;--per;ed- Renewals may only be granted by the City Manager upon findings and recommendations by the Director of the Department of Planning '^'g that such renewals are in the best interest of the City for reasons related to insufficient parking within proximity of a major facility; seehTenewz„s shall Pet be P-XteaQedbGYe„doeserph-er 31, 2502. At such time that renewals are granted, the City Manager may include conditions to mitigate safety concerns that arise as reported by the NET Administrator, Code Enforcement or the Miami Police Department that pertain to the particular parking facility in question. Parking spaces provided on this type of interim parking facility shall not be counted toward meeting required parking for any such major public facility. 916.2.3. Interim special use parking. Interim special use parkina facilities shall be permitted as a conditional use on non -residentially zoned lots, within a one thousand (1000) foot radius of the special uses they are intended to serve, pursuant to a Class II Special Permit subject to the applicable criteria in Section 1305, and only in conjunction with uses such as special entertainment districts, government facilities or institutional uses whose scale and operation warrant the use of interim parkina facilities on a more dailv vear-round use than special event venues Renewals may only be aranted by the Citv Manaaer upon findinas and recommendations by the Director of the Department of Planning that such renewals are in the best interest of the City for reasons related to insufficient parking within proximity of the special uses. Considerations and standards. In order to mitigate any potentially adverse effects that unimproved interim parking lots may have on adjacent areas, all such facilities intended to be utilized as sit-terrp eueRt pa, RRg—as described in sections 916.2.2. and 916.2.3. above, shall be required to maintain a park -like appearance to consist of fully sodded lots over an approved stabilized, below grade, pervious system or any other type of system which provides a honeycomb type stabilized base underneath the lot and therefore allows for parking on the sod while not impeding drainage. In lieu of providing a park -like appearance as described above, a parking facility may be paved upon approval by the public works director of a sufficient alternate drainage system. Interim parking facilities may also be used for the temporary staging of miscellaneous equipment and/or vehicles necessary for any of the functions associated with an approved special event or an activity taking place in a major public facility subject to all applicable regulations and special permits listed above. All interim parking and staging activities permissible under this section shall be limited in duration to a time specified in the special permit obtained. The duration shall run concurrently with the event or activity requiring said parking or staging, and may be expanded on a limited basis to allow for preparation, disassembly and activities related to that specific event or activity. In addition to the considerations and standards listed generally in section 1305 of this ordinance, Class I and Class II Special Permits for interim parking facilities shall also consider the following: (a) Use of traffic monitors to facilitate vehicular flow into and out of such facilities during major events; (b) Use of specialized lighting features to ensure safety when such facilities are proposed for evening use; and (c) Use of perimeter fencing to assist in the control of access points and security of proposed lots while not in use. (d) Surface interim parking lots, which are located within the SD -5, SD -6, SD -7, SD -20 or designated CRA areas of Southeast Overtown/Park West or Omni, &ha4 may also be 661bjeGt required to comply with the conditions and criteria set forth in Section 917.3.2. as conditions to the special permits required herein or as conditions of time extensions granted by the City Manager. (e) All such interim parking lots may also be required to comply with any design standards and guidelines that may be in place for the specified area in which the parking lot is located (i.e. uniform signage, fencing and attendant kiosk standards). Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective thirty (30) days after approval at second reading, unless vetoed by the Mayor within ten days from the date it was passed and adopted. Signage- as per section 35-283 and 35-284 all parking lots shall have two signs, one at each entrance of the parking lot for which a license is granted, or if one entrance, then two signs at such entrance, with letters not less than six inches in size printed or painted thereon, indicating the lot type (i.e. Temporary special event parking, short term event parking, or interim parking), city license number, company name, lot physical address, emergency contact number, and total number of vehicles allowed, as well as indicating the price and fees charge for automobile parking and the period of time for which such fee or price is charged. The sign shall be displayed not less than five feet from the ground nor more than eight feet above the ground. 2. Lighting- for all lots utilized after dusk lighting shall be required and should be of adequate intensity and placement to create a near daylight appearance without creating unnecessary shadows or dark zones and arranged to prevent glare or excessive light on adjacent properties. 3. Fencing- perimeter fencing shall be required to control access to lots to specified entrances and exits and shall not be of the chain link type but shall be either decorative wrought iron or aluminum picket or other decorative yet secured fencing subject to the review and approval of the Director of the Department of Planning and Zoning. Also required will be access gates allowing the lot to be secured when not in used. 4. Surface- parking lot surface shall be level, clean of obstacles, debris and any items which could cause injury or damage to patrons and their vehicles. If lot does not have adequate drainage resulting in excessive standing water lot can not be operated until the condition no longer exists. 1 5. Parking attendant- all lots without defined parking stalls and access isles shall be required to have a dedicated parking attendant designated to direct the movements of vehicles entering and exiting the lots. This attendant shall be separate from the parking attendant assigned to the entrance or exit of said lot. Parking attendant shall be present from one hour prior and for a minimum of 45 minutes after lot has been opened and closed. Parking attendants shall be required to submit a formal application and photo ID to parking lot operators which shall be kept on file and subject to review. Employees shall be required to wear uniform shirts or vests identifying themselves as employees of the licensed operator. Parking attendants assigned to the entrance and exit shall keep an accurate count of number of vehicles inside the lot at all times, subject to review by Code Enforcement Officers, City Police Officers and City Parking Network employees. 6. Security- lots capable of containing 50 vehicles or more or operators operating several lots at one time which total 50 vehicles or more are required to have licensed uniform security separate from the parking attendants required to operate the lot or lots, for one hour prior to and for a minimum 45 minutes after lot has been open and closed. Lots having the capacity of over 125 vehicles shall require a minimum of one City Police Officer, instead of uniform security. 2
