HomeMy WebLinkAboutR-09-0092Vop City of Miami Legislation < U R �O Resolution: R-09-0092 File Number: 09-00174b City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 2/26/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION REQUIRING EACH BIDDER RESPONDING TO A CONSTRUCTION RELATED PROJECT BID SOLICITATION TO PROVIDE INFORMATION ON PROPOSED H-213 VISA USAGE AND INTENDED LOCAL WORKFORCE USAGE. WHEREAS, the federal government grants H-213 Work Visas which are issued to non -immigrants allowing foreign nationals to enter the United States temporarily and engage in non-agricultural employment which is seasonal, intermittent, a peak -load need or a one-time occurrence; and WHEREAS, the H-213 Work Visa was created to allow foreign nationals to enter into the United States temporarily, mainly for non-agricultural jobs, in which the United States workers are in short supply; and WHEREAS, the City Commission desires to ensure that the City of Miami ("City") closely monitor the use of H-213 Work Visa workers on City contracts; and WHEREAS, in response, any City department soliciting a construction related project now requires in all bid solicitations, that bidders provide information on proposed H-213 Work Visa usage, justification, and intended usage of local workforce; and WHEREAS, it is further required that subsequent to award and during the term of a contract, the contractor provide updates on the actual usage of H-213 Work Visa workers; and WHEREAS, the City Manager recommends, in order to continue to expedite the award of contracts and maintain project timelines, that the City Manager conduct a review of all disclosures for signs of misuse prior to award, and to provide City Commissioners with quarterly reporting of all H-213 Work Visa usage on awarded contracts; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission requires each bidder responding to a construction -related project solicitation to disclose information on proposed H-213 Work Visa usage, justification, and intended usage of local workforce, with said disclosure in writing. Section 3. It shall be unlawful to employ any device, scheme or artifice to circumvent the disclosure requirements of this section and such circumvention shall be deemed a violation of the City of Miand Page 1 of 2 File Id. 09-00174b (Version: 1) Printed On: 6/1/2017 File Number: 09-00174b disclosure requirements of this section. Enactment Number: R-09-0092 Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1 } Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
