HomeMy WebLinkAboutR-09-0087Vop City of Miami Legislation < U R �O Resolution: R-09-0087 File Number: 09-00128 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 2/26/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PROCUREMENT OF MAINTENANCE AND REPAIR SERVICES OF FERNO EMERGENCY AMBULANCE COTS, FROM MEDCO EQUIPMENT REPAIR, INC., D/B/A EMSAR OF SOUTH FLORIDA, FOR THE DEPARTMENT OF FIRE -RESCUE, ON AN AS -NEEDED BASIS, FOR A ONE (1) YEAR PERIOD, WITH THE OPTION TO EXTEND FOR TWO (2) ADDITIONAL ONE-YEAR PERIODS, AT A FIRST YEAR COST NOT TO EXCEED $20,000, WITH THE OPTIONAL ANNUAL INCREASES NOT TO EXCEED FIVE PERCENT (5%); ALLOCATING FUNDS, FROM THE VARIOUS SOURCES OF FUNDS OF THE USER DEPARTMENT, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED. WHEREAS, the Department of Fire -Rescue ("Fire -Rescue") requires regular maintenance and repair and on-call emergency repairs of its Ferno emergency ambulance cots; and WHEREAS, Ferno, the manufacturer of these medical cots, has contracted with Medco Equipment Repair, Inc. d/b/a EMSAR ("EMSAR") of South Florida, as its sole source agent in this service area to provide services and support for Ferno products; and WHEREAS, in addition to repair and maintenance, EMSAR provides preventive maintenance to extend the life of the equipment and ensure lower risks of field failures; and WHEREAS, funds will be allocated from the various sources of funds of the user department, subject to the availability of funds and budgetary approval at the time of need; and WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer has adopted a finding that EMSAR, is the sole source provider in this service area of maintenance and repair of Ferno emergency ambulance cots; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive formal sealed bids be waived and that the procurement of maintenance and repair services for Ferno emergency ambulance cots from EMSAR as the sole source, be approved; City of Miand Page 1 of 2 File Id. 09-00128 (Version: 1) Printed On: 5/31/2017 File Number: 09-00128 Enactment Number: R-09-0087 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding of a sole source, is ratified, approved and confirmed pursuant to Section 18-92 of the City Code, the requirements for competitive sealed bidding procedures are waived, and the procurement of maintenance and repair services of Ferno emergency ambulance cots, from EMSAR, for the Department of Fire -Rescue, is approved, on an as -needed basis for a one (1) year period, with the option to extend for two (2) additional one-year periods, at a first year cost not to exceed $20,000, with the optional annual increases not to exceed five percent (5%), with funds allocated from the various sources of funds of the user department, subject to availability of funds and budgetary approval at the time of need. Section 3 This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
