A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO GRANT ALLAPATTAH COMMUNITY
HOUSING II, INC., AN EXTENSION OF TIME TO COMPLETE CONSTRUCTION
FROM DECEMBER 1, 2008 TO MARCH 1, 2009, ON THE PROPERTY LOCATED
AT 1390 NORTHWEST 24TH AVENUE, MIAMI, FLORIDA), AS LEGALLY
DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY REQUIRED
MODIFICATIONS TO THE DEED(S) THAT CONVEYED THE PROPERTY FROM
THE CITY OF MIAMI TO ALLAPATTAH COMMUNITY HOUSING II, INC., AND ALL
NECESSARY DOCUMENTS, FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 04-0380, adopted June 10, 2004, the Miami City
Commission approved the conveyance of the City of Miami ("City") owned property located at 1390
Northwest 24th Avenue, Miami, Florida ("Property"), to Allapattah Community Action, Inc. ("ACA"), a
Florida not-for-profit corporation, for the development of Affordable housing; and
WHEREAS, on June 29, 2004, an Agreement for Purchase and Sale was executed between the
City and ACA; and
WHEREAS, ACA requested that to facilitate the receipt of the United States Department of
Housing and Urban Development's ("HUD's") 202 Program funding and to mitigate the costs in
connection therewith the City convey the Property directly to Allapattah Community Housing II, Inc.,
the not-for-profit organization created by ACA to receive the HUD 202 Program funding; and
WHEREAS, pursuant to Resolution No. 07-0541, adopted September 27, 2007, the Miami City
Commission authorized the conveyance of the Property to Allapattah Community Housing II, Inc., for
the development of rental housing for elderly individuals and/or families with very low, low and/or
moderate income; and
WHEREAS, on September 27, 2007, a Special Warranty Deed was executed between the City
and Allapattah Community Housing, II, which required that construction be completed on December 1,
2008; and
WHEREAS, due to the delays in the installation and availability of the required electrical meters
and the power source needed for the final testing of equipment and all the life safety components
from Florida Power and Light, Allapattah Community Housing II, Inc. is requesting that the
construction completion date for the project be extended from December 1, 2008 to March 1, 2009;
and
WHEREAS, the Administration recommends granting Allapattah Community Housing II, Inc. an
extension of time to complete construction from December 1, 2008 to March 1, 2009 on the Property,
as legally described in Exhibit "A," attached and incorporated;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to grant Allapattah Community Housing II, Inc. an
extension of time to complete construction from December 1, 2008 to March 1, 2009, on the Property,
as legally described in "Exhibit A," attached and incorporated.
Section 3. It is the intention of the Miami City Commission that title to the parcel described above
and in "Exhibit 'A" attached and incorporated, shall be deemed to have remained in Allapattah
Community Housing II, Inc. from the date of conveyance.
Section 4. The City Manager is further authorized{1} to execute any required modifications to the
deed(s) that conveyed the properties from the City to Allapattah Community Housing II, Inc., and all
necessary documents, for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including, but not limited to, those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
