HomeMy WebLinkAboutR-09-0066Op City of Miami City Hall 3500 4, Pan American F Drive Miami, FL 33133 Legislation www.miamigov.com i 0 R �O Resolution: R-09-0066 File Number: 09-00064 Final Action Date: 2/12/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS TO PURCHASE AND/OR LEASE REAL PROPERTIES LOCATED WITHIN THE CITY OF MIAMI, PURSUANT TO TITLE III OF DIVISION B OF THE HOUSING AND ECONOMIC RECOVERY ACT 2008, FOR THE PURPOSE OF ASSISTING IN THE REDEVELOPMENT OF ABANDONED AND FORECLOSED HOMES UNDER THE EMERGENCY ASSISTANCE FOR REDEVELOPMENT OF ABANDONED AND FORECLOSED HOMES, A/K/A NEIGHBORHOOD STABILIZATION PROGRAM, FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ("HUD"), WITH FUNDS AWARDED TO THE CITY OF MIAMI BY HUD, IN THE AMOUNT OF $12,063,702, FOR AN EIGHTEEN (18) MONTH PERIOD, FOR SAID PURPOSE. WHEREAS, on July 30, 2008, the President of the United States signed the Housing Economic Recovery Act of 2008 ("HERA"), which includes the Neighborhood Stabilization Program ("NSP"), administered by the United States Department of Housing and Urban Development ("HUD"); and WHEREAS, the NSP provides targeted emergency assistance to state and local governments to acquire and redevelop foreclosed properties that might otherwise become sources of abandonment and blight within their communities; and WHEREAS, the City of Miami ("City") has one of the highest rates of foreclosed homes in the nation; and WHEREAS, HUD has awarded a grant in the amount of $12,063,702 to the City in Community Development Block Grant ("CDBG") funds; and WHEREAS, the Department of Community Development administers CDBG funds and has the sole responsibility to administer these CDBG funds to effectuate the purposes of the NSP; and WHEREAS, HERA mandates that these CDBG funds must be committed "within eighteen (18) months of receipt of the amounts, as required by HUD"; and WHEREAS, the negotiation for the purchase of foreclosed and abandoned properties must be completed within the "eighteen (18) month" time period as contemplated by HUD; and WHEREAS, most lenders require buyers of foreclosed properties to be able to quickly go into contract and close on the properties; and WHEREAS, the Department of Community Development shall use due diligence in identifying City of Miand Page 1 of 2 File Id. 09-00064 (Version: 1) Printed On: 5/31/2017 File Number: 09-00064 Enactment Number: R-09-0066 properties to purchase that will effectuate the purpose of the NSP and will also be in accordance with policies as approved by the City Commission; and WHEREAS, the Department of Community Development will ensure that purchases and/or leases of real properties are done pursuant to the statutory rules and regulations of the NSP; and WHEREAS, for the limited purpose of complying with the requirements of the NSP, the City Manager has the authority to execute agreements for the purchase and/or lease of real properties located within the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1 } to execute Agreements to purchase and/or lease real properties located within the City, pursuant to Title III of Division B of HERA, for the purpose of assisting in the redevelopment of abandoned and foreclosed homes under the Emergency Assistance for Redevelopment of Abandoned and Foreclosed Homes, a/k/a NSP, from HUD, with funds awarded to the City by HUD, in the amount of $12,063,702, for an eighteen (18) month period, for said purpose. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including, but not limited to, those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
