It is quite obvious that corrections need to be made in our Legistar system so the it agrees with Municode. Please advise as to how the Law Department plans to make the correction as we cannot certify the legislation as it currently exists in Legistar. The information in Municode is correct, however, when the legislation was adopted the incorrect naming for the subsections occurred. At this point, I don't believe there's anything that our office needs to do. Dr. Shiny, this is the section we worked on, prior to speaking with Law. From: Samuel A. Barnaby, I did some further digging through the code, and I believe 4-11 (i)(5)0) waives the distance limitations in the 8th Street Cultural District. However, I think it was meant to be 4-110) (not a subpart of (i)(5).) You may want to look at that with the clerk's office. Please confirm that I am reviewing the correct portion of the code concerning distance limitations in the 8th Street Cultural District. Thanks. Samuel A. Rubert' Subject: RE: 8th Street Culteral Specialty District Good morning Mr. Rubert: In requesting this record, it has come to our attention that the attached enacting ordinances 13050 and 13051 incorrectly named the subsections "m" and "n". Ordinance 13050 added section "m" to section 4-11 of the code and Ordinance 13051 added section "n", however, the ordinances names the sections as "I" and "m". Section "I" was previously added to the code through Ordinance 13047 (I've also attached this for your reference). If you compare the attached ordinances to Municode this will verify the language that was updated. Our office has notified the Office of the City Attorney about the error, however, for your purposes I've attached both Ordinances with the exhibits mentioned in the code. If you need further clarification on the explanation above, please contact me. For legal interpretation of the code or attached ordinance you may contact the Office of the City Attorney at (305) 416-1800. Thanks, Nicole From: Samuel A. Rubert [mailto:srubert@rubertlaw.com] Sent: Wednesday, January 12, 2011 3:36 PM To: Min, Barnaby Subject: 8th Street Culteral Specialty District Barnaby, I have a client who is looking to open a business in the 8th Street Cultural Specialty District, and he has asked me to do a zoning investigation concerning uses and placement of an alcoholic beverage license. I am having trouble interpreting section 4-11 of Chapter 4 dealing with exceptions to the distance requirements for businesses located within the 8th Street Cultural Specialty District., and I was hoping you could help. There is a reference in the definition of Cultural Specialty Districts to 4-11(1), but 4-11(1) does not seem to exist, and there are two sections 4-11(m) & 4-11(n) which seem to be what I am looking for, but instead of defining or naming the district, they merely refer to an "attached" exhibit which is not available on Municode or anywhere else I am aware of. Can you get me a copy of the attachments referenced therein or confirm if and which of those sections applies to 8th Street? Thanks, and if this is confusing or you need more information, please do not hesitate to contact me. Samuel A. Rubert Attorney at Law Samuel A.
