Bernadin Application For Variance

Dear Ms. Fernandez,
I wish to file an appeal to the Zoning Board for the denial of my Variance application for
my Property located at 3244 SW 3rd Avenue, Miami, Fl, 33127,
i have attached letters of support from my immediate neighbors in support of this
Variance application and readdressed the Zoning Board Staff concerns in their analysis
for the variance application.
I respectfully request the opportunity to present this information at a hearing to the City
Commission.

established in the Citi"s Zoning Ordinance for a Variance.
Specifically -
(a)
Special conditions and circumstances exist which are particular to the land,
structure, or building involved and which are not applicable to other lands,
structures, or buildings in the same Zoning District in that:
(b)
The special conditions and circumstances do not result from the actions of
the petitioner in that:
The property was bought as is with the 2nd unit already converted from a garage to a
dwelling unit by the previous owner(s). This is my attempt as current owner to legalize
the conversion and meet all current Building and Zoning Code requirements.
Literal interpretation of the provisions of the Zoning Ordinance would deprive
the applicant of rights commonly• _•. by other properties In the same
Zoning District under the terms of the Zoning Ordinance and would work
unnecessary and undue hardships on the petitioner in that.
As previously stated, the modifications to the existing 2nd dwelling unit suggested by
the Zoning and Planning Boards Staff to meet the current dwelling unit size requirement
of 560 SF will have little or no impact to the character of the neighborhood. Satisfaction
of the literal provisions of the Zoning Ordnance would impose an undue hardship in
that significant portions of the existing 2nd dwelling unit would have to be demolished,
redesigned, and rebuilt imposing unnecessary construction costs and engineering
expenses to a residence in character with the neighborhood and supported by the
abutting property owners.
