A RESOLUTION OF THE MIAMI CITY COMMISSION WITH ATTACHMENT(S),
APPROVING A SPECIAL EXCEPTION, REQUIRING CITY COMMISSION
APPROVAL, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401,
UNDER CONDITIONAL PRINCIPAL USES IN PR PARK, RECREATION AND OPEN
SPACE DISTRICT, TO ALLOW THE CONSTRUCTION OF A TEMPORARY FIRE
RESCUE FACILITY, WITH ATIME LIMITATION OF TWELVE (12) MONTHS IN
WHICH A BUILDING PERMIT MUST BE OBTAINED SUBJECT TO CONDITIONS,
FOR THE PROPERTY LOCATED AT APPROXIMATELY 1275 NORTHEAST 79TH
STREET, MIAMI, FLORIDA.
WHEREAS, the Miami Waterfront Advisory Board, at its meeting on November 25, 2008, following
an advertised public hearing, adopted Resolution No. WAB-2008-15 by a vote of seven to zero (7-0),
recommending APPROVAL of the Pelican Harbor Park Temporary Fire Station No. 27; and
WHEREAS, the Miami Zoning Board, at its meeting on December 8, 2008, following an advertised
public hearing, adopted Resolution No. ZB-08-088 by a vote of seven to zero (7-0), item no. Z.3,
recommending APPROVAL of a Special Exception as set forth, subject to the following condition by
the Planning Department: A landscape plan signed and sealed by a landscape architect, listing all
planting materials with a tree mitigation plan to be submitted for review and approval by the Planning
Department prior to issuance of any building permits; and
WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of
Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth;
and
WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding
the decision of the Zoning Board, finds the application for the Special Exception meets the applicable
requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best
interest of the general welfare of the City of Miami and its inhabitants to reverse the decision of the
Zoning Board and grant the Special Exception as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The Special Exception, as listed in Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Article 4, Section 401, under conditional uses in PR Parks Recreation
and Open Space, to allow for the construction of a temporary fire rescue facility for the property
located at approximately 1275 Northeast 79th Street, Miami, Florida, legally described in attached

"Exhibit A," pursuant to plans on file, subject to the following condition by the Planning Department: A
landscape plan signed and sealed by a landsccape architect, listing all planting materials with a tree
mitigation plan to be submitted for review and approval by the Planning Department prior to issuance
of any building permits, and subject to a time limitation of twelve (12) months in which a building
permit must be obtained; is granted.
Section 3. The findings of fact set forth below are made with respect to the subject property:

These findings have been made by the City Commission to approve this project with conditions.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1 }
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
