HomeMy WebLinkAboutR-09-0030Vop City of Miami Legislation < U R �O Resolution: R-09-0030 File Number: 08-01503 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 1/15/2009 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE THE FOURTH AMENDMENT TO THE CONTRACT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND CONDO ELECTRIC MOTOR REPAIR, CORP., PURSUANT TO RESOLUTION NO. 07-0005, ADOPTED JANUARY 11, 2007, FOR ADDITIONAL WORK REQUIRED FOR THE PROJECT ENTITLED "STORMWATER PUMP STATION MAINTENANCE AND REPAIR, B-30395" IN AMOUNT NOT TO EXCEED $100,000, INCREASING THE THIRD YEAR OF THE CONTRACT FROM $229,400 TO $329,400; FURTHER ALLOCATING ADDITIONAL FUNDS IN AMOUNT NOT TO EXCEED $20,000 PER YEAR FOR THE REMAINING TWO OPTIONS TO RENEW, INCREASING THE ANNUAL CONTRACT AMOUNT FROM $229,400 TO $249,000; ALLOCATING FUNDS FROM PUBLIC WORKS GENERAL ACCOUNT NO. 00001.208000.534000.0.0 FOR SAID INCREASE. WHEREAS, the City of Miami ("City") and Condo Electric Motor Repair, Corp., entered into a contract ("Contract") dated March 22, 2007 for the project entitled "Stormwater Pump Station Maintenance and Repair, B-30395," pursuant to Resolution No. 07-0005, adopted January 11, 2007, for a one-year period with the option to renew for four (4) additional one (1) year periods; and WHEREAS, Amendment No. 1 to the Contract was executed on March 31, 2008 to exercise the first option to renew; and WHEREAS, Amendment No. 2 to the Contract was executed on August 8, 2008 to correct an error in the retainage provision of said Contract; and WHEREAS, Amendment No. 3 to the Contract was executed on January 7, 2009 to exercise the second option to renew; and WHEREAS, additive items incorporated in the Contract are in need of upgrades and repairs in order to prevent flooding in the streets; and WHEREAS, it is in the best interest of the City to increase the Contract with Condo Electric Motor Repair, Corp., in order to provide said upgrades and repairs to the pump stations; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute the Fourth Amendment to the Contract, in substantially the attached form, between the City and Condo Electric Motor Repair, Corp., pursuant to Resolution No. 07-0005, adopted January 11, 2007, for additional work required for the project City of Miand Page 1 of 2 File Id. 08-01503 (Version: 2) Printed On: 5/25/2017 File Number: 08-01503 Enactment Number: R-09-0030 entitled "Stormwater Pump Station Maintenance and Repair, B-30395," in an amount not to exceed $100,000, increasing the third year of the Contract from $229,400 to $329,400; further allocating additional funds not to exceed $20,000 per year for the remaining two (2) options to renew, increasing the annual Contract amount from $229,400 to $249,000. Section 3. Funds are allocated from Public Works General Account No. 00001.208000.534000.0.0 for said increase. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: S{1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
