HomeMy WebLinkAboutPre Legislation 2FEB -20-2003 17:34 CITY MANRGERS OFFICE 305 416 1019 P.03/06 RESOLUTION NO, A RESOLUTION OP THE MIAMI CITY COMMISSION AUTHORIZING THE CONVEYANCE OF TWO (2) C''TY- OWNED VACANT PARCELS LOCATED IN THE ALLAPATTAH NEIGRBORHOOD TO ALLAPATTAH BUSINESS DEVELOPMENT AUTHORITY, INC. AS nEVELOPER AT NO COST FOR THE DEVELOPMENT OF TWO (2) NEW SINGLE-FAMILY HOMES AFFORDABLE TO FAMILIES AND INDIVIDUALS 07 LOTAT AND MODERATE INCOME, SUBJECT TO THE DEVELOPER: (i) AGREEING TO PAY T:3E COST OF ELIMINATING ALL TITLE DEFECTS EXISTING ON THE PARCELS, (2) PROVIDING EVIDENCE ACCEPTABLE TO TEE CITY OF FIRM COMMITMENTS FOR PROJECT C01-17STRUCTION AND PERMANENT FINANCING FOR PURCHASE BY QUALIFIED HOMEBUYERS, (3) COMMENCING CONSTRUCTION WIT:3IN TWELVE (12) MONTHS FROM THE DATE OF CONVEYANCE BY THE CITY, (4) COMPLYING WITH OTHER TERMS AND CONDITIONS, INCLUDING PARCEL REVERTER PROVISIONS, AS DEEMED APPROPRIATE BY THE CITY MANAGER AND THE CITY ATTORNEY, AND (5) PROVIDING THE ADMINISTRATION WITH A STATUS REPORT CONCEMING TF.E TITLE TO THE PARCELS WITHIN NINETY (90) DAYS FROM THE DATE O:' CONVEYANCE; AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE, SUBJECT TO APPLICABLE CITY CODE PROVISIONS. WHEREAS, a severe shortage of housing exists in the City of Mi ami (City) within the affordability range of families and individuals of low and moderate -income; and WHEREAS, pursuant to Resolution No. 99-429, adopted July 22, 1999, the City Commission approved the City's proposed Five FEB -20-2003 17:34 CITY MfAgGERS OFFICE 305 416 1019 P. 04,1W, (5) Year Consolidated Plan (1999-2004) (pian) For submission to the U.S. Department of Housing and Urban Deve?opMent including, as a major component of the Plan, a housing strategy aes_gned to facilitate the annual creation of 1,000 new homeownersh:.p units for -purchase by very low, low and moderate income families; and WHEREAS, the two (2) parcels are vacant properties owned by City of Miami and the development plan proposed by Allapattah Business Development Authority, Inc. conforms to the Plan; and TaTHBREAS, Section 29-B of the Charter of the , City of Miami, Florida, as amended, allows for the conveyance or disposition of City -owned property ir. connection with the implementation of City -assisted housing programs or. -projects _intended to benefit persons or households of low or rwderate-income without competitive .bidding requirements and fair market value return to the City] NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fury set forth in this Section. Section 2. The conveyance of the following two (2) parcels at no cost to the Developer is hereby authorized subject to the Developer (3) agreeing to pay the cost of eliminating all title defects existing on the parcels, (2) providing evidence Page 2 of 4 FEB -20-2003 17.34 CITY MPNqGERS OFFICE 305 416 1019 P.05/06 acceptable to the City of firm commitments for project construction and permanent financing for purchase by qualified low and moderate income hamenuyers, (3) commencement of construction on the parcels within twelve (12) months =rom the date of conveyance to the Developer by the City, (4) complying with other terms and conditions, including reverter provisions for each parcel, as deemed appropriate by the City manager and the City Attorney, and (5) providing the administration with a status report concerning the title to the parcels within ninety (90) days from the date of conveyance: 790 NW 29 Terrace 2374 NW 33 Street Section 3, The City Manager is hereby authorized to execute all necessary document (a), in a form acceptable to the City Attorney, subject to applicable City Code provisions. Section 4. This Resolution shall become effecci.ve immediately upon its adoption and signature of the Mayor.' PASSED AND AMP= this day of 1. 2003_ MAIa'UEL A. DIAZ, MAYOR If the Mayor does not sign this Resolution, it shall become ef-fective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
