A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR-FIFTHS
(4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS
FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE
PURCHASE OF ELECTRONIC SOFTWARE (INCLUDING TRAINING AND A
ONE-YEAR MAINTENANCE AGREEMENT), TO OPERATE THE CELLULAR
TRACKING SURVEILLANCE EQUIPMENT, EQUIPPED WITH TWO
ELECTRONIC DEVICES KNOWN AS THE STING -RAY 4 -CH AND KINGFISH
1 -CH, FROM HARRIS GOVERNMENT COMMUNICATIONS SYSTEMS DIVISION
WIRELESS PRODUCTS GROUP, FOR THE DEPARTMENT OF POLICE, IN AN
AMOUNT NOT TO EXCEED $75,800; ALLOCATING FUNDS FROM THE
EDWARD BYRNE MEMORIAL JUSTICE ASSISTANT GRANT, PROJECT NO.
19-190001, ACCOUNT CODE NO. 12000.191602.664000.0000.
WHEREAS, the City of Miami Department of Police will be purchasing the StingRay 4 -CH and
KingFish 1 -CH, from Harris Government Communications Systems Division Wireless Products Group
("Harris") utilizing the federal GSA IT 70 Schedule Contract #GS -35F -0283J, as authorized pursuant to
Resolution No. 06-0238, adopted April 27., 2006; and
WHEREAS, the electronic software is necessary to operate both the StingRay 4 -CH, the newest
cellular tracking surveillance equipment available, capable of intercepting and tracking numerous
cellular phones including PCS wireless and the KingFish 1 -CH, used in conjunction with the StingRay
to provide investigators with a covert tool for extracting data from a CDMA mobile system; and
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended ("City
Code"), the Chief Procurement Officer has adopted a finding that Harris is the sole source provider of
the electronic software (including training and a one-year maintenance agreement), to operate the
Cellular Tracking Surveillance Equipment equipped with two electronic devices known as the
Sting -Ray 4 -CH and Kingfish 1 -CH; and
WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the,
findings of the City Manager; and
WHEREAS, the City Manager and the Chief Procurement Officer recommend that the
requirements for competitive formal sealed bids be waived and the purchase of the electronic software
(including training and a one-year maintenance agreement) to operate the Cellular Tracking
Surveillance Equipment equipped with two electronic devices known as the Sting -Ray 4 -CH and
Kingfish 1 -CH, as the sole source be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City Code,
after an advertised public hearing, the City Manager's finding of a sole source, waiving the
requirements for competitive sealed bidding procedures are ratified, approved and confirmed, and the
purchase of electronic software (including training and a one-year maintenance agreement), to operate
the cellular tracking surveillance equipment, equipped with two electronic devices known as the
Sting -Ray 4 -CH and KingFish 1 -CH, from Harris, in an amount not to exceed $75,800, is approved,
with funds allocated from the Edward Byrne Memorial Justice Assistant Grant, Project No. 19-190001,
Account Code No. 12000.191602.664000.0000.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1)
