Hernandez DATE: December 11, 2008 FILE: City Manager SUBJECT: Waiver of Competitive Procurement Requirements: Approval of Proposals and Issuance of Purchase Order FROM: Ola 0. Aiuko REFERENCE: Grapeland Park Project, Director 4 B-35828 Department of Capital Improvements ENCLOSURES: BACKGROUND Pursuant to Resolution R-05-0137, the City Commission granted approval to enter into a Design - Build Agreement with Recreational Design & Construction, Inc. (RDC) for the Grapeland Park Project, B-35828. Bureau Veritas North America d/b/a Bureau Veritas (Bureau Veritas) performed environmental services for the Grapeland Park Project as a Sub -Consultant to RDC. They are no longer working with RDC for this project. DERM requires additional documents and groundwater monitoring for a minimum of one year for the project. Bureau Veritas is familiar with the site history, existing contaminants and closure routes, exiting engineering controls, additional engineering controls, and submittal of the closure documentation and additional monitoring schedule. FINDING In the interest of maintaining continuity of work, it has been determined by the Capital Improvements Program (CIP) that using another environmental consultant would considerably delay closure and ultimately cost the City undue additional expenditures. CIP finds that it is most practicable and advantageous to the City for Bureau Veritas to perform the additional work, rather than competitively solicit the work. We recommend that the City Manager concur to waive the formal requirements set forth in the Code of the City of Miami, as amended in sections 18-87, 18-90 and under Florida Statutes Section 287.055 and affirm, adopt these findings and forward the matter to the City Commission for its approval.
