Re: Land Use Amendment and Rezoning for the Properties Located at 118 SW South River
Drive: 437 SW 2 ST: and 445 SW 2 ST.
This letter of intent shall confirm "RIVER INN SRD, LLC" (herein referred to as Applicant)
is applying to amend the Comprehensive Neighborhood Plan Future Land Use Map for the
property located at 118 SW South River Drive; 437 SW 2 ST; and 445 SW 2 ST and further
identified by Miami -Dade Tax Folio Nos. 01-0201-080-1020; 01-0201-080-1160; and
01-0201-080-1150 respectively. This letter supports the application for an amendment to the
Comprehensive Neighborhood Plan Future Land Use Map from Medium Density Multi -family
Residential to Medium Density Restricted Commercial for the Property. In addition, the
Applicant is requesting a rezoning from T4-R to T5-O for the Property.
Property. The Property is located at the intersection of SW South River Drive and SW
2nd Street, adjacent to SW 1st Street Bridge. Presently, Under Miami 21 the current zoning on
the Property is T4-R, which zones the Historic River Inn Hotel out of compliance. The Historic
River Inn is Miami's oldest standing hotel and has been operating as a such since as early as
1908. Currently, it is listed on the National Register of Historic Places (NR) as South River Drive
Historic District. The Property is also a locally designated resource in the City of Miami.
Land Use and Rezoning Requests. The Applicant is requesting a land use change from
Medium Density Multi -Family Residential to Medium Density Restricted Commercial for the

Property and a zoning change from T4-R to T5-O in order to extend the Medium Density
Restricted Commercial and T5-O zoning transect from across SW South River Drive, SW 1st
Street and SW 5th Ave. The proposed change would be consistent with the extent of Medium
Density Restricted Commercial land use designation and serve as a transition between the T4-
R to the South of the Property and the T6-8-12 to the North of the Property. The main goal of
this amendment is to support the use of the existing Historic Hotel.
Criteria: Section 7.1.2.8(f) of Miami 21 provides the criteria for amendments to Miami
21. The provision provides as follows [fjor all amendments:
(a) The relationship of the proposed amendment to the goals, objectives and
policies of the Comprehensive Plan, with appropriate consideration as to whether the
proposed change will further the goals, objectives and policies of the Comprehensive
Plan; the Miami 21 Code; and other city regulations.
(b) The need and justification for the proposed change, including changed or
changing conditions that make the passage of the proposed change necessary.
The proposed amendment is consistent with the goals, objectives, and policies
of the Miami Comprehensive Neighborhood Plan ("MCNP"). For instance, Objective
LU-1.3 states as follows:
"The City will continue to encourage commercial...development within existing
commercial...areas; increase the utilization and enhance physical character and
appearance of the existing buildings; within a walkable area in accordance with
neighborhood design and development standards adopted as a result of the
amendments to the City's land development regulations and other initiatives;"
Additionally, Objective LU-2.4 states as follows:
"Increase the number of historic structures that have been preserved,
rehabilitated or restored, according to the U.S. Secretary of the Interior's Standards for
Rehabilitation."

The Property is located within an area designated on the FLUM as Medium Density
Multi Family Residential. The Applicant requests a re -designation and a rezoning from the
T4-R transect zone to T5-O and an amendment to the Comprehensive Neighborhood Plan
Future Land Use Map from Medium Density Multi -family Residential to Medium Density
Restricted Commercial in order to accommodate the existing Historic Hotel. Approval of this
application will enhance the neighborhood and acknowledge the historically designated
resources on The Property.
The Applicant would like to emphasize the HEPB Resolution designating the Property a
Historic Resource as well as the National Designation Resolution for the South River Drive
Historic District. Additionally, the Historic Preservation Office issued a Certificate of
Appropriateness which approved the renovation of the Historic Hotel in accordance with the
highest historic preservation standards (HEPB-R-15-101) completed in 2017. The approval of
this application would correct the in -place zoning transect which zones the Historic River Inn
out of compliance.

When Miami 21 was implemented, several properties in East Little Havana were zoned out of
compliance. This analysis will look at the assemblage located at 118 SW South River Drive,
437 SW 2 ST and 445 SW 2 ST. Under Miami 21, the current zoning on the properties is T4-R,
which zones the Historic River Inn Hotel out of compliance.
The Owner would like to correct the zoning on folio numbers 01-0201-080-1020,
01-0201-080-1160, and 01-0201-080-1150 to be T5-O and have it conform to its original Hotel
use. The Historic River Inn is Miami's oldest standing hotel and has been operating as a such
since as early as 1908. Currently, it is listed on the National Register of Historic Places (NR) as
South River Drive Historic District. The property is also designated by the City of Miami.
The property has undergone a restoration wherein the structures, parking, and original use are
"existing to remain". The Vagabond Group obtained a Resolution from the Historic and
Environmental Preservation Board (HEPB) and renovated the River Inn to the highest historic
preservation standards.

Attached is our letter of intent to correct the zoning for the Historic Miami River Inn, comprised
of the contiguous properties located at 118 SW South River Drive, 437 SW 2 ST, and 445 SW 2
ST. Under Miami 21 the current zoning on this assemblage is T4-R, which zones the Historic
River Inn Hotel out of compliance.
River Inn is Miami's oldest standing hotel and has been operating as a such since as early as
1908. Currently, it is listed on the National Register of Historic Places (NR) as South River Drive
Historic District. The property is also designated Historic by the City of Miami. For your
reference we have attached the National Designation report and the City of Miami local
designation report. The property has undergone a restoration wherein the structures, parking,
and original use are "existing to remain". The Vagabond Group obtained a Resolution from the
Historic and Environmental Preservation Board (HEPB) and renovated the River Inn to the
highest historic preservation standards.
This letter is our effort to inform the NET office that we are submitting this request to the City of
Miami.

The South River Drive Historic District is significant to the history
of architecture and community development in Miami. Developed
primarily during the first two decades of the twentieth century, the
district contains the City's oldest extant grouping of frame
vernacular buildings in such close proximity to the Miami River.
Thesa buildings embody those characteristics of South Florida's frame
vernacular architecture and exemplify the architectural trends in
Miami prior to 1915. The district's location, period of construction,
and use reflect tht historical development of the City of Miami.
In the early years of the 1900's, suburban expansion in Miami extended
only to the north and south of the City. It was not until 1906 that
significant westerd expansion was possible. At that time, work began
on the Everglades drainage project, and a bridge and short-lived
trolley car line were constructed over the Miami River at the foot of
Flagler Street. It was shortly after this, circa 1908, that the first
building in the South River Drive Historic District was constructed.
All six of the historic buildings within the district were completed
by circa 1914.
It is unlikely that the buildings within the South River Drive
Historic District were ever single family residences, with the
exception of 437 S. W. 2 Street. If such was their original use, it
was short-lived. The owners of these buildings soon began to take in
boarders, and the buildings became rooming houses. The large size
(two and two -and -one-half stories) of these buildings made them easily
adaptable to such a use. In addition, their strategic location in
proximity to the Miami River and the Flagler Street bridge, coupled
with the events of the period, made the structures prime targets for
this transformation.
The year 1896, which brought rapid change, development, and growth to
the fledgling City of Miami, also brought with it an increase in
population. New residents, as well as tourists, began arriving,
literally, by the train load. While the Royal Palm Hotel attracted
Rockefellers, Astors, and Vanderbilts, as well as U. S. Congressmen
and European royalty, the less wealthy tourists and potential new
residents also needed accommodations. Rooming houses such as the ones
found in the South River Drive Historic District fulfilled this need.
An advertisement for an establishment similar to these, but no longer
standing, read: "Reasonable Rates, for Table, Board." Another
proclaimed: "An ideal winter home for the tourist, an all -year hotel
for the transient." The area west of the Miami River soon began to
fill with comfortable, unassuming residences and rooming houses as the
City of Miami rapidly expanded. •

architectural character should be preserved as a reminder of
Miami's past.

The 'largest rooming house in the South River Drive Historic District
is khown as the Rose Arms and is located at 118 S. W. South River
Drivd. Its first owners were John C. Baile and his wife Rose. The
Bailds may have operated a rooming house complex, for they also
as the owners of 428 S. W. 1 Street and 104 and 109 S. W. South River
Drive'. While the Rose Arms remained under Baile proprietorship for
several years, the other three properties were sold to Charles L.
Gibbons and his wife, Isabella, as early as 1914. By 1918, Charles 0.
Sims and his wife, Winifred, appear as the owners of 428 S. W. 1
Street. Sims was employed by the Hagan Realty Company. In 1915,
James C. Smith and his wife, Josephine, are recorded as owners of 438
S. W. 1 Street. James Smith was a physician. Although this structure
may first have served as a single family residence, it was later
referred to as the New Jersey Guest House. The structure located at
437 S. W. 2 Street, built circa 1913, seems to have always been a
single family residence. Its first residents were the Eberwines.
William C. Eberwine was a milliner who worked for the Chaffin
Millinery Shop. In later years, he was employed by the Southern Feed
Company as Secretary and Treasurer. This building is a typical
example of the type of house constructed in this working class
neighborhood.
The buildings within the South River Drive Historic District are
representative of the early frame vernacular architecture of South
Florida. The frame vernacular mode reflects the open, rural character
of the area at that time and is well adapted to the local climate.
The buildings retain a high degree of architectural intergrity.
The South River Drive Historic District is one of Miami's most unique
groupings of historic buildings. The district has remained a cohesive
unit, despite the presence of several non-contributing structures.
Relationship to Criteria for Designation:
The South River Drive Historic District is eligible for designation
under the following criteria:

III. DtSCRIPTIDN
The South River Drive Historic District i5 a small grouping of hid 21r2
buildings in East Little Havana. Located on the southwest bank of
Miami River, the district encompasses approximately one half of a
square block and includes ten buildings as well as several
outbuildings. The majority of buildings are frame vernacular
structures of balloon frame construction and are two or two -and -one-
half stories. The primary use is single or multi -family residential.
Most of the buildings within the district were constructed between 1908
and 1914, the area's major period of significance. Four buildings in
the district, however, fall outside the area's major period of
significance and are considered non-contributing structures.
The six contributing buildings in the South River Drive Historic
District are united by a strong architectural theme. These frame
vernacular structures are rectangular in plan and are two or two -and -
one -half stories tall. Four have gable roofs of medium pitch with
gable roof dormers. The other two are topped with hipped roofs. Roof
covering is of composition shingles, except for 438 S. W. 1 Street,
which has been re -roofed with galvanized aluminum. Original roofing
materials on all of the structures cannot be ascertained due to the
lack of early photographs. However, similar buildings in the area
from that period were known to have used composition shingles, wood
shingles, and metal for roofing. All roofs have slightly projecting
eaves and exposed rafter ends. Exterior wall covering on all buildings
is horizontal weatherboards. Structures are raised off the ground on
masonry foundation piers. Original windows were wood frame, double
hung sash, with one -over -one lights. Many of these windows remain.
The six buildings retain a high degree of architectural integrity and
have not been significantly altered.
The buildings at 438 and 428 S. W. 1 Street are sited perpendicularly
to the river, with their main access through a metal bridgeway on the
second floor connected to the elevated S. W. 1 Street bridge over the
Miami River. 104 S. W. South River Drive is located at the corner of
S. W. South River Drive and S. W. 1 Street, immediately adjacent to the
two previously mentioned structures, and directly across the street
from the Miami River. 109 South River Drive stands on the west bank of
the Miami River, across the street from the main group. The last
contributing building, 437 S. W. 2 Street, is around the corner from
the main group, perpendicular to the river, and related to the others
through its backyard.
All non-contributing structures are located in the southeast corner of
the district. The buildings include a three story apartment building
on S. W. South River Drive and three small two story apartment
buildings on S. W. 2 Street.

IV. PLANNING CONTEXT

The South River Drive Historic District is located in the easternmost
part of East Little Havana, an area plasjued by deterioration and
crime. Problems in the area were recently addressed by the East
Little Havana Task Force, and recommendations for improvement were
presented to the City Commission.
All buildings within the district have been acquired (or are under
contract) by Magic City Enterprises, the group responsible for the
rehabilitation of the nearby J. W. Warner House. Magic City hopes to
convert the district into a bed and breakfast inn. The group believes
that the rehabilitation of these buildings will spur redevelopment in
the neighborhood. Rehabilitation. has been completed on one building
and begun on a second. Completion is targeted for December 1986.
Conservation Objectives:
Historic district designation should be used as a tool to recognize
the historic importance of the South River Drive area and promote its
preservation. Magic City Enterprises is to be commended for its
commitment to East Little Havana and should be encouraged in its
efforts. Because existing zoning will not permit the proposed bed and
breakfast inn, a change of use is necessary.
The proposed HC-5: Commercial -Residential Heritage Conservation
Overlay District would provide the zoning incentives necessary to make
the preservation of these buildings feasible. HC-5 would permit a
change of use to allow hotels/tourist homes and would allow accessory
uses not to exceed 20 percent of the total floor area. Certain retail
uses compatible with the historic character of the district would also
be permissible, as would modifications to off-street parking
requirements. All alterations to the exterior of the buildings, as
well as the change of use, would require the approval of the Heritage
Conservation Board.

The boundaries of the South River Drive Historic District have been
drawn to include all contiguous property owned or under contract to
purchase by Magic City Enterprises. These boundaries encompass the
neighborhood's largest concentration of buildings that were
constructed during the 1900's and 1910's and that still retain their
integrity. The four non-contributing buildings on lots 16, 17, and 18
were included because they are (or will be) under the same ownership,
are functionally related to the proposed new use for the district, and
need to be regulated to preserve the historic integrity of the
adjacent buildings.

review.
Major Landscape Features Subject to Review:
The major landscape features subject to review shall include all
features which are subject to requirements for tree removal permits,

ACKNOWLEDGEMENT BY APPLICANT
1. The Department of Resilience and Public Works, Transportation, Coordinated Review Committee and other City
and County agencies review zoning public hearing requests and provide input, which may affect the scheduling
and outcome of my hearing. These reviews may require additional hearings before other City and County
boards, which may result in the modification of plans, studies and/or the proffering of agreements to be
recorded. The submission and acceptance of a request for public hearing means that the application is ready to
be scheduled for public hearing. I am also aware that I must comply promptly with any City or County conditions
and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.0) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any
fees paid.
6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, as per the Code.
7. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan.
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per
the Code.

violation. This report may include two types of liens: Certified liens and non -certified
liens. Certified liens have a set amount to be paid. Conversely, most non -certified liens
continue to accrue interest or a per diem fine; therefore, those liens must be satisfied
with the City as quickly as possible.
All outstanding violations and liens must be satisfactorily resolved before the City can
issue a Certificate of Use (CU); however, the City inspects all properties prior to the
issuance of a CU and those inspections may yield additional items, which must be

adaptable to such use. In addition, their strategic location in
proximity to the iami River and the Flagler Street bridge, coupled
with the event of the period, made the structures prime targets for
this t'ansfo ion.
The year 1:.6, which brought rapid change, development, and growth to
the fled. ing City of Miami, also brought with it an increase in
populat'.n. New residents, as well as tourists, began arriving,
litera y, by the train load. While the Royal Palm Hotel attracted
Rock_ ellers, Astors, and Vanderbilts, as well as U. S. Congressmen
an. European royalty, the less wealthy tourists and potential new
r=.idents also needed accommodations. Rooming houses such as the ones
*.und in the South River Drive Historic District fulfilled this need.
An advertisement for an establishment similar to these, but no longer
standing, read: "Reasonable Rates, for Table, Board." Another
proclaimed: "An ideal winter home for the tourist, an all -year hotel
for the transient." The area west of the Miami River soon began to
fill with comfortable, unassuming residences and rooming houses as the
City of Miami rapidly expanded. •

and 1914, the area's major period of significance. Four buildings in

District are united by a strong archite ural theme. These frame
vernacular structures are rectangular in an and are two or two -and -

gable roof dormers. The other two are opned with hipped roofs. Roof
covering is of composition shingles except for 438 S. W. 1 Street,
which has been re -roofed with galv ized aluminum. Original roofing

lack of early photographs. Ho ver, similar buildings in the area
from that period were known t. have used composition shingles, wood
shingles, and metal for roof g. All roofs have slightly projecting
eaves and exposed rafter end-. Exterior wall covering on all buildings
is horizontal weatherboard . Structures are raised off the ground on
masonry foundation piers Original windows were wood frame, double
hung sash, with one-ov: -one lights. Many of these windows remain.
The six buildings retn a high degree of architectural integrity and
have not been s ign if ' antly altered.
The buildings at ' 8 and 428 S. W. 1 Street are sited perpendicularly
to the river, th their main access through a metal bridgeway on the
second floor c' nected to the elevated S. W. 1 Street bridge over the
