The Property fronts SW 2 Avenue, between SW 17 Road and SW 15 Road. See Figure 1, Aerial, below. The Miami -Dade County Property Appraiser's Office identifies the Property with Folio No. 01-4138-001-3950. The Property is approximately 5,850 square feet in size and a has fifty (50) feet of frontage on SW 2 Avenue with no rear or side access. The Future Land Use Map ("FLUM") of the City's Comprehensive Neighborhood Plan ("MCNP") designates the Property "Restricted Commercial." See Figure 2, FLUM Excerpt, below. Zoning. The Miami 21 Zoning Code ("Miami 21") GIS Atlas provides that the Property is within the T6-8 Urban Core Transect Zone with the "0" or "Open" designation. See Figure 3, Zoning Excerpt, below. In order to accommodate seven (7) off-street parking spaces, the Applicant will utilize efficient mechanical parking lifts. To minimize impacts of the new hotel use, the roof will contain modest amenities for guests. Additionally, only units fronting SW 2 Avenue contain balconies. PZ-22-15497 10/04/23 Land Use Analysis. The proposed Project is consistent with the Goals, Objectives and Policies of the MCNP. Specifically: • Goal LU-3- Encourage urban redevelopment in identified Urban Infill Areas and Urban Redevelopment Areas. The Project is within an Urban Infill Area and redevelopment of the Property will activate a small, under-utilized parcel. • Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. Approval of the Project will encourage a lodging use in close proximity to the Brickell area, which offers a number of tourism, dining, and shopping opportunities. • Objective TR-1.1- Encourage sustainable growth and development that aims to improve mobility, reduce congestion, and supports the overall growth strategy of the City. The Project's location in close proximity to transit and in close proximity to the attractions of the Brickell area promotes walkability and reduces congestion associated with visitors to the Brickell area. PZ-22-15497 10/04/23 The Project is in close proximity to transit and reinforces the pattern of neighborhoods and urban centers by providing the perfect transition from the density and intensity of the Brickell area to more residential areas to the south and west. Zoning Analysis The goal of this urban infill redevelopment is consistency with the Urban Core Zone, which permits the highest density and greatest variety of uses, with buildings set close to the frontage with frequent doors and windows. The Project will significantly improve the pedestrian experience in this area and encourage transit ridership as envisioned by inclusion the TOD area. Exception Request. Pursuant to Article 4, Table 4 of Miami 21, as amended on April 28, 2022, in T6 Transects there are certain parking reductions available for sites not within 500 feet of an ungated T3 Transect Zone and within a TOD area or within a Transit Corridor area. The Property is within a TOD and seeking a waiver of the 500 feet of an ungated T3 Transect Zone requirement. Therefore, the Property is eligible for up to fifty percent (50%) reduction by process of Exception with City Commission approval and payment into a transit enhancement trust fund, as established by Chapter 35 of the City Code. The minimal parking reduction requested is necessary to ensure the narrow site, with limited access, accommodates sufficient maneuverability while still providing functional parking spaces to meet the operational demand. The intent of Miami 21 to encourage multimodal transit is addressed with the Property's proximity to mass transit. There is a covered bus shelter at the intersection of SW 13 Street and SW 15 Road for Metrobus 24, which travels from Coral Way and SW 137 Avenue to the Brickell Metrorail/ Metromover station. Just southeast of the Property is a Citi Bike sharing station, and the Financial District Metromover Station is less than a 10-minute walk. The Applicant agrees to meet with the Planning Department prior to building permit to coordinate payment into the transit enhancement trust fund. Waivers. Pursuant to Article 7, Section 7.1.2.5 of Miami 21, Waivers permit minor deviations from the Zoning Code, as provided in the various articles of Miami 21 and as consistent with the guiding principles of Miami 21. PZ-22-15497 10/04/23 The overall Project, with the Waivers to reduce the distance from T3, increase lot coverage, reduce the required frontage at the setback are necessary to due to the confining characteristics of the Property and promote the intent of the T6 Transect Zone. Specifically, the transient -oriented, mixed -use Project is in harmony with the T6 description, which provides that the Urban Core Zone consist of the highest density and greatest variety of uses. This is the ideal location for a boutique hotel in close proximity to public transportation, major transportation corridors, and highways within the City, and the minor deviations from the land development regulations are the minimum deviations necessary to carry out the design. Further, the Project enhances the pedestrian experience and minimizes any potential impact of the minor deviations of Miami 21. Distance to T3. As identified in Figure 4, the Property is included in the area eligible to request a reduction in parking. The Property is separated from the nearest T3 zoned area by a large hotel project, NW 1 Avenue, the Metrorail line, and Simpson Park. The area between 1-95 and SW 15 Road contains a number of existing hotel projects that do not impact the residential areas. The immediate surrounding context is more similar to the intense T6 zoned area and sufficiently buffered from the T3 zoned area. Therefore, any possible negative impact from seeking a parking reduction is mitigated by distance, variety of uses, and limited access and view. Lot Coverage. Accommodating adequate pedestrian and vehicular access, parking, back of house, and electrical facilities, on this narrow lot provide special practical difficulties in planning the upper hotel units. The Project ensures the units are appropriately setback from all frontages, balconies are limited to only on one frontage, and necessary amenities are located on the roof level. The slight increase in lot coverage is the minimum necessary, while still complying with setbacks and frontage requirements for a viable boutique hotel in the urban core. Height of Mechanical Equipment. The Code permits stairs, elevators, and mechanical equipment reach ten feet (10') as of right, and to exceed this amount by Waiver. The Applicant therefore respectfully requests this Waiver in order to permit a five feet (5') mechanical screen on top of the stairs, as show in Figure 5 below and A-302. Article 2.2.2 related to Conflicts confirms that "Where the requirements of this Miami 21 Code vary with the applicable requirements of any law, statute, rule, regulation, ordinance, or code, the most restrictive or that imposing the higher standard shall govern." As it relates to the Property, the Building Code and Public Works roadway access requirements govern the width of driveways and visibility triangles throughout the City. The Project is providing the maximum frontage possible to maintain proper access. However, the limited access on this narrow lot creates a hardship based on the existing size of the lot, which is platted, and has existed at its current size for decades. Given the access, drive aisle, and visibility triangle requirements, tt is impossible to provide seventy percent (70%) of the building at the frontage and still provide vehicular access to the site for on -site parking. The lot is only fifty feet (50') in width, and even providing the minimum vehicular access, the frontage at the front setback requirement conflicts with the vehicular, life -safety requirements. Accordingly, given the life -safety implications associated with the required vehicular access, they are the more restrictive requirements, which must be satisfied. Nonetheless, the design improves the pedestrian environment and will continue the experience from SW 15 Road along SW 2 Avenue. Conclusion. The Project is an urban infill development that will contribute to the mix of uses within this TOD area and in close proximity to mass transit. A boutique hotel will contribute to the success of the adjacent businesses, with minimal impact to the nearby multi -family residences. We believe that the Project significantly improves the existing conditions at the Property and benefits the streetscape.
