WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as amended ("City Code"), titled "Temporary Events in General," temporary events on private property are limited to no more than two (2) events per year per property for a maximum of two (2) weeks per permit; and WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events can be waived upon affirmative vote of the City Commission; and WHEREAS, padel ball is a fast rising sport, attracting people of all ages to play; and WHEREAS, Padel X has leased the private property located at 1361 Northeast 1 Avenue, Miami, Florida ("Event Site") in order to hold padel ball events and competitions; and WHEREAS, Padel X will create pop-up courts in order for both visitors and residents to enjoy this new sport; and WHEREAS, the Event is already processing its temporary event permit under number SE0-23-12-TEP-701 and is set to start activity on February 12, 2024; and WHEREAS, the Event wishes to continue to operate past the initial two (2) events for only two (2) weeks as provided in the City Code and requires a waiver starting February 26, 2024 in order to do so; and WHEREAS, the Event at the Event Site do require permits to be issued by the City of Miami ("City") to ensure life -safety and quality of life issues and appropriate conditions may be imposed on each permit as well as compliance with all other Sections of the City Code; and WHEREAS, the Event at the Event Site will be beneficial to the City's residents and visitors; and WHEREAS, in accordance with Section 2-33(f) of the City Code, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 62-521(b)(4) of the City Code, titled "Temporary Events in General," the two (2) temporary events per year for two (2) weeks limitation on private property is hereby waived for the Event at the Event Site starting February 26, 2024, and for a period of six (6) months thereafter. Section 3. This Resolution does not waive any other requirements of the City Code, including but not limited to, noise restrictions, applicable fees, inspections, and permits. Section 4. This Resolution shall become effective immediately upon its adoption.
