HomeMy WebLinkAboutResolutionCity of Miami Resolution Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14960 Final Action Date: 1/11/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5) AFFIRMATIVE VOTE, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S EMERGENCY FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A," PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY"), FOR THE SELECTION OF ORLY PROSOUND PRODUCTION CORPORATION, A FLORIDA PROFIT CORPORATION ("ORLY PROSOUND"), FOR THE PURCHASE AND INSTALLATION OF CINEMA LIGHTING AND AUDIO/VISUAL EQUIPMENT AT THE TOWER THEATER, FOR THE GRAND OPENING OF THE CELIA CRUZ EXHIBIT ON JULY 14, 2023, FOR THE APPROXIMATE AMOUNT OF ONE HUNDRED THIRTEEN THOUSAND SIX HUNDRED DOLLARS ($113,600.00); AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING ANY AMENDMENTS OR MODIFICATIONS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") Department of Real Estate and Asset Management ("DREAM") required cinema lighting and audio/visual equipment to be furnished and installed at the Tower Theater for the Grand Opening of the Celia Cruz Exhibit on July 14, 2023; and WHEREAS, the City's Department of Procurement ("Procurement"), on behalf of DREAM, issued two (2) Invitations for Quotations ("IFQ's") for the purchase and installation of the cinema lighting and audio/visual equipment; and WHEREAS, the pre -qualified vendors responding to the IFQ's could not meet DREAM's timeline due to the market's supplier demand shortage, and Orly Prosound Production Corporation, a Florida profit corporation ("Orly Prosound"), was able to timely provide said equipment and its installation, for the approximate amount of One Hundred Thirteen Thousand Six Hundred Dollars ($113,600.00); and City of Miami Page 1 of 2 File ID: 14960 (Revision:) Printed On: 1/18/2024 File ID: 14960 Enactment Number: WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of Miami, Florida, as amended ("City Code"), approved an emergency finding, waiving competitive sealed bidding methods as not being advantageous or practicable for this emergency purchase from Orly Prosound; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to thi -solutio adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5) affirmative vote, pursuant to Section 18-90 of the City Code, the City Manager's emergency finding, attached and incorporated as Exhibit "A," waiving the requirements for competitive sealed bidding methods as not being practicable or advantageous to the City, for the selection of Orly Prosound, for the purchase and installation cinema lighting and audio/visual equipment at the Tower Theater, for the Grand Opening of the Celia Cruz Exhibit on July 14, 2023, for the approximate amount of One Hundred Thirteen Thousand Six Hundred Dollars ($113,600.00), is hereby ratified, approved, and confirmed. Section 3. The City Manager is hereby authorized to negotiate and execute any and all documents, including any amendments or modifications, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption.
