HomeMy WebLinkAboutAgenda Item Summary FormAGENDA ITEM SUMMARY FORM File ID: #14894 Date: 10/17/2023 Commission Meeting Date: 12/14/2023 Requesting Department: Department of Parks and Recreation Sponsored By: Christine King District Impacted: District 5 Type: Resolution Subject: Emergency Finding - HVAC - Roberto Clemente Park Purpose of Item: The nature of this item is to authorize a resolution of the Miami City Commission, by a four -fifths (4/5) affirmative vote, ratifying, confirming and approving the City Manager's emergency finding, that is it most advantageous for the City of Miami to waive the competitive sealed bidding procedure pursuant to Section 18-90 of the Code of the City of Miami, Florida as amended ("City Code") and retroactively approving the selection of Kal-Tech Controls LLC, ("Kal-Tech") to access and repair the heating, ventilation, and air conditioning ("HVAC") controls system at Roberto Clemente Park, for an approximate amount of $31,000.00; Authorizing the City Manager to negotiate and execute any and all documents, including any amendments, modifications, for the access and repair of the HVAC controls system at Roberto Clemente Park; subject to all allocations, appropriations, and budgetary approvals having been previously made, compliance with applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including, the City of Miami's Procurement Ordinance, Anti - deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Background of Item: On July 11, 2023, the City of Miami's Department of Parks and Recreation ("Parks") requested an emergency repair of the HVAC automated temperature controls system at the Roberto Clemente Community Center Building. The repair was necessary in order to perform a "Test and Balance" protocol to the mechanical equipment. The "Test and Balance" report determines what further repairs are needed to the HVAC controls system. Kal-Tech, a registered vendor for the City was able to access the HVAC controls system at Roberto Clemente Park. Pursuant to Section 18-90 an emergency access and repair to the HVAC controls system was done to prevent further accumulation of mold in the interior of the building, and Parks is requesting a retroactive approval of the repair of the HVAC controls system at Roberto Clemente Park by Kal- Tech. WHEREAS, the heating, ventilation, and air conditioning ("HVAC") controls system at Roberto Clemente Park was in dire need of repairs; and WHEREAS, the repair to the HVAC controls system was necessary in order to perform a "Test and Balance" protocol to the mechanical equipment, to determine if yet further repairs were also needed; and WHEREAS, emergency repair of the HVAC controls system was also performed to prevent the accumulation of mold in the interior of the building; and WHEREAS, Kal-Tech Controls LLC, a Florida limited liability company, performed the emergency repair of the HVAC controls system for the approximate amount of Thiry One Thousand Dollars ($31,000.00); and WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of Miami, Florida, as amended ("City Code"), approved an emergency finding, waiving the requirements for competitive sealed bidding methods as not being advantageous or practicable for the City and this emergency repair; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, the City Manager's emergency finding, attached and incorporated as Exhibit "A," pursuant to Section 18-90 of the City Code, waiving the requirements for competitive sealed bidding methods as not being advantageous or practicable to the City, for the selection of Kal-Tech, for the access and repair of the HVAC controls system at Roberto Clemente Park, for an approximate amount of Thirty One Thousand Dollars ($31,000.00), is hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to negotiate and execute any and all documents, including any amendments or modifications, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption.
