A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AFTER AN ADVERTISED PUBLIC HEARING, AUTHORIZING AND DIRECTING THE
CITY MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO
EXPEDITIOUSLY REQUEST THE MIAMI-DADE COUNTY TRANSPORTATION AND
PUBLIC WORKS DEPARTMENT ("DTPW') TO CONSIDER THE PROPOSED
TRAFFIC FLOW MODIFICATIONS, WAIVE THE REQUIRED RESIDENT/PROPERTY
OWNER CONCURRENCE, AND EXEMPT THE BALLOTING PROCESS IN ORDER
TO EXPEDITIOUSLY PROCEED WITH THE DESIGN AND CONSTRUCTION OF
TRAFFIC CALMING DEVICES AT FOURTEEN (14) LOCATIONS, TWELVE (12) IN
THE COCONUT GROVE AND TWO (2) IN THE MORNINGSIDE RESIDENTIAL
NEIGHBORHOODS, IN DISTRICT 2, MORE PARTICULARLY DESCRIBED HEREIN;
DIRECTING THE CITY CLERK TO SEND A CERTIFIED COPY OF THE THIS
RESOLUTION TO THE DTPW DIRECTOR.
WHEREAS, several locations in the City of Miami's ("City") Coconut Grove and
Morningside residential neighborhoods experience significant cut -through traffic and speeding
during rush hour periods; and
WHEREAS, such cut -through traffic and speeding on a local residential street not
designed for such volume diminishes residents' quality of life; and
WHEREAS, in addition to quality of life problems such as noise and general congestion,
such cut -through traffic and speeding creates significant life -safety risks as residential streets
are narrower than nearby arterial roadways, increasing the risk of vehicular accidents including
those involving pedestrians; and
WHEREAS, those who cut -through residential neighborhoods during rush hour traffic
tend to disobey posted speed limits and signage to gain an advantage over using arterial
roadways meant for such traffic; and
WHEREAS, in order to alleviate these issues, the City proposes to install twelve (12)
traffic calming devices at several locations in the Coconut Grove residential neighborhood and
install two (2) traffic calming devices in Morningside neighborhood as those neighborhoods
experience significant cut -through traffic and speeding during morning and afternoon rush hour
periods, all as described in Exhibit "B," attached and incorporated; and
WHEREAS, Section 1.6 of the Miami -Dade County Traffic Flow Modification(s)/Street
Closure(s) Procedure, as revised by the Miami -Dade County Public Works Department ("PWD")
Traffic Engineering Division in January 2009, attached and incorporated as Exhibit "A" ("County
Procedure"), requires concurrence of affected residents and/or property owners; and
WHEREAS, Section 1.6 of the County Procedure further states: "Municipal Jurisdictions:
In lieu of concurrence from the affected residents and/or property owners, a municipality may
pass a resolution after a public hearing requesting PWD [now known as the Miami -Dade County
Department of Transportation and Public Works ("DTPW')] to consider the proposed traffic flow
modification(s)/street closure(s)"; and
WHEREAS, in order to expeditiously address these quality of life and life -safety issues,
the City desires to install the fourteen (14) traffic calming devices, as more particularly described
in Exhibit "B," attached and incorporated, in Coconut Grove and Morningside of District 2
without delay by holding a public hearing in lieu of resident/property owner concurrence through
balloting; and
WHEREAS, in lieu of concurrence from the affected residents and/or property owners,
the City Commission finds it in the best interest of the City and its residents to pass a resolution
after a public hearing requesting PWD/DTPW to consider the proposed traffic flow
modification(s)/street closure(s) as described in Exhibit "B," attached and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. The City Commission, after a public hearing, authorizes' and directs the City
Manager to take any and all actions necessary to expeditiously request that DTPW consider the
proposed traffic flow modifications at the following twelve (12) locations within the Coconut
Grove neighborhood of District 2, and two (2) locations in Morningside neighborhood of District
2, as more particularly described in Exhibit "B," attached and incorporated, in order to
expeditiously proceed with the design and construction of the traffic calming devices:
1. Intersection of La Playa Boulevard and Poinciana Avenue
2. Intersection of Poinciana Avenue and Solana Road
3. Poinciana Avenue between Douglas Road and Justison Road
4. Intersection of Braganza Boulevard and Crawford Avenue
5. Intersection of Kent Road and Poinciana Avenue
6. Intersection of Kent Court and Poinciana Avenue
7. Intersection of Poinciana Avenue and Frantz Road
8. Intersection of Loquat Avenue and Pamona Lane
9. Intersection of Loquat Avenue and Brooker Street
10. Avocado Avenue between Plaza Street and Hibiscus Street
11. Intersection of Hibiscus Street and Avocado Avenue
12. Woodridge Road between Southwest 42 Avenue and Brighton Place
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
13. Northeast 55 Terrace west of Northeast 6 Avenue
14. Northeast 55 Terrace east of Northeast 7 Avenue
Section 3. The City Clerk is directed to send a certified copy of this Resolution to the
Director of DTPW.
Section 4. This Resolution shall become effective immediately upon its adoption.
