Rezoning Request PZ-22-15020 06/09/23 Rtt'rEw COO The Applicant requests to rezone the Property to T6-24B-O by extending the existing zoning directly east of the Property pursuant to the successional zoning requirements of Section 7.1.2.8 of Miami 21. As indicated in the City's Zoning Atlas, the properties abutting the Property to the east are zoned T6-24B-O. As such, the Applicant's proposal to extend an existing Transect boundary to the Property meets the threshold criteria for rezoning consideration. Further, for the reasons outlined in the enclosed Rezoning Application Analysis, the proposed rezoning is appropriate for the Property, meets the criteria set forth in Section 7.1.2.8(c)(2)(g) of Miami 21 as it is in conformance with the Comprehensive Plan, the established land use pattern for the adjacent properties and the immediate area, and is in scale with the needs of the neighborhood. Under the Comprehensive Plan, the Property is designated General Commercial and is located within the UCBD. The Comprehensive Plan provides that properties designated "General Commercial" and located within the UCBD "allow a maximum floor lot ratio (FLR) of 37.0." (emphasis added). The current T6-24A-O zoning designation is directly contrary to the Comprehensive Plan as it only permits a maximum FLR of 7 at the Property. In summary, the proposed rezoning to T6-24B-O will accomplish the City's goals through the implementation of its very own Comprehensive Plan. 2. The Property's location and the existing conditions in the surrounding area support the proposed rezoning to T6-24B-O. The Property is centrally located between significant cultural, entertainment and recreational venues. The Property is located in the OMNI CRA redevelopment area and the Performing Arts Center District (the "PAC District") and within a one-half mile radius of Wynwood, Edgewater, Downtown Miami, and Miami Worldcenter, areas of the City that continue to experience rapid population and business expansion. Also located within a one-half mile radius of the Property are important public recreational, entertainment, and transportation amenities including the Adrienne Arsht Center for the Performing Arts, the Knight Concert Hall, the I-395 Signature Bridge and associated 30-acre linear park which are currently under construction, and three Metromover Stations (School Board Station, Adrienne Arsht Center Station, and Eleventh Street Station). In recent years, development of the PAC DISTRICT has made this area a hub of culture, dining, shopping and entertainment. The OMNI area is the point of connection between Downtown Miami and the areas of Design District, Midtown and Wynwood creating an ideal location for both residents and visitors to live, work and play. The proposed ground floor retail on the Property will create active pedestrian areas by providing connectivity with the surrounding commercial spaces and provide a gathering place within the OMNI area for visitors and residents alike. As stated earlier, the Comprehensive Plan provides that properties designated "General Commercial" and located within the UCBD "allow a maximum floor lot ratio (FLR) of 37." Similarly, under the existing zoning designation and FLUM designations, the Property is permitted development up to 48 stories and a maximum density of 500 units per acre. However, these maximum densities and intensities are unattainable under the current FLR multiplier of 7. The rezoning to T6-24B-O would permit an FLR multiplier of 16, which would result in development that is consistent with the City's vision for the Property and the surrounding area given its Comprehensive Plan designation. Without the rezoning, the Property would not be able to achieve a viable development potential in permitted stories or density under Miami 21 and the Comprehensive Plan. The rezoning will correct this inconsistency in the Property's current zoning thereby implementing the City's Comprehensive Plan in accordance with the intent of Miami 21 which encourages denser development in areas that are well served by transit. 4. The proposed rezoning will permit a cohesive and unified development with increased Floor Area at the Property in accordance with the guiding principles of Miami 21. The Property's existing T6-24A-O zoning designation permits a maximum FLR multiplier of 7 and a Bonus FLR 30%. The proposed rezoning to T6-24B-O will permit a cohesive and unified development of the Property by permitting a maximum FLR multiplier of 16 and a 40% Bonus Floor Area increase while requiring on -site Affordable/Workforce Housing to obtain any the additional Floor Area. This increase in FLR and associated Affordable/Workforce Housing potential will permit increased development which will be consistent with the character, scale and uses of the surrounding area. The increased floor area will permit larger units as well as more functional balconies for the residents of the proposed development. Moreover, the proximity to Downtown Miami enhances the need for maximum lot coverage to further promote the much needed residential and commercial development in the area, as well as an activation of the pedestrian realm. More importantly, the required on -site Affordable/Workforce Housing will further the guiding principles of Miami 21 and address the City's current and projected Affordable/Workforce Housing needs. 5. The changing conditions and recent rezonings in the immediate vicinity of the Property warrant the proposed rezoning to T6-24B-O. The rapid growth of the surrounding area supports and demands the zoning change to a higher transect zone designation which will promote growth along transit nodes.
