A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF -SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY
THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT"), FOR IMPROVEMENTS ON STATE ROAD
972/CORAL WAY/ SOUTHWEST 3 AVENUE FROM 400 FEET WEST OF
SOUTHWEST 12 AVENUE TO BRICKELL AVENUE, MIAMI, FLORIDA, FOR
GENERAL ROADWAY IMPROVEMENTS IN THIS CORRIDOR, INCLUDING
IMPROVEMENTS ON ROADS NOT ON THE STATE HIGHWAY SYSTEM.

WHEREAS, the Florida Department of Transportation ("FDOT") has developed design
plans Financial Management ("FM") Project No. FM 445998-1-52-01 for State Road ("SR")
972/Coral Way/Southwest 3 Avenue from 400 feet west of Southwest 12 Avenue to Brickell
Avenue for the milling and resurfacing of the existing asphalt pavement, ADA improvements,
upgrading pavement markings and replacing substandard signs, upgrading pedestrian
signalization features and replacing signal and lighting pull -boxes ("Project"); and
WHEREAS, FDOT intends to undertake and complete the Project, a portion of which
includes work on roads not on the State Highway System but City of Miami ("City") right-of-way,
specifically Southwest 31 Road from Station 43+50 to Station 43+85 Left/Right, SW 26 Road
from Station 61+25 to Station 61+85 Left/Right, SW 25 Road from Station 64+90 to Station
65+80 Left/Right, SW 15 Road from Station 99+90 to Station 100+40 Right, SW 2 Avenue from
Station 103+80 to Station 104+45 Left/Right, SW 1 Avenue from Station 110+85 to Station
111+30 Left/Right, South Miami Avenue from Station 116+65 to Station 117+65 Left/Right, and
Brickell Avenue (for purposes of this agreement, the "Off -System Project Limits") and
WHEREAS, the Project includes pavement restoration through milling and resurfacing,
widening, upgrading pavement markings and replacing substandard signs, driveway
reconstruction, and incidental sidewalk reconstruction and paver re -set due to proposed
signalization improvements ("Local Roadway Improvements") and all activities associated with,
or arising out of the construction of the Local Roadway Improvements; and
WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"),
attached and incorporated as Exhibit "A," establishes the terms, conditions, and responsibilities
of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's
Streets; and
WHEREAS, the City agrees with the terms and conditions in the Agreement, in
substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to execute the Agreement, in substantially
the attached form, with FDOT, for the Project on SR 972/Coral Way from south of Interstate 95
to east of Southwest 3rd Avenue, Miami, Florida, which includes improvements on roads not on
the state highway system, and the Local Roadway Improvements.
Section 3. This Resolution shall become effective immediately upon its adoption.
