Enclosed you will find an ad for notice of a public hearing to be held by the City Commission on September
28, 2023, to grant a perpetual, non-exclusive easement containing a combined total size of approximately six
hundred sixty-three (663) square feet on City of Miami property located at 4355 SW 42 Avenue, Miami,
Florida.
Please place the ad in accordance with public hearing requirements of the City Commission.

NOTICE OF PUBLIC HEARING
A public hearing will be held by the City Commission of the City of Miami, Florida on
Thursday, September 28, 2023, at 9:00 A.M. at City Hall, located at 3500 Pan
American Drive, Miami, Florida, 33133 for the purpose of granting the following:
A RESOLUTION OF THE MIAMI CITY COMMISSION, PURSUANT TO SECTION 29-
B(C) OF THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT
("EASEMENT"), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE
FLORIDA POWER & LIGHT COMPANY, A FLORIDA PROFIT CORPORATION, FOR
A PERPETUAL, NON-EXCLUSIVE EASEMENT CONTAINING A COMBINED TOTAL
SIZE OF APPROXIMATELY SIX HUNDRED SIXTY-THREE (663) SQUARE FEET
("EASEMENT AREA") OF CITY OF MIAMI ("CITY") OWNED PROPERTY LOCATED
AT 4355 SOUTHWEST 42 AVENUE (FOLIO NO. 01-4129-000-0150), MIAMI,
FLORIDA ("PROPERTY"), FOR THE PURPOSE OF CONSTRUCTION, OPERATION,
AND MAINTENANCE OF UNDERGROUND ELECTRIC UTILITY FACILITIES,
INCLUDING CABLES, CONDUITS, APPURTENANT EQUIPMENT, AND
APPURTENANT ABOVE GROUND EQUIPMENT, IN ACCORDANCE WITH THE
TERMS AND CONDITIONS OF THE EASEMENT, WITH THE RIGHT TO
RECONSTRUCT, IMPROVE, AND REMOVE ALL OR ANY OF THE FACILITIES
WITHIN SAID EASEMENT AREA LOCATED AT THE PROPERTY.
The Miami City Commission requests all interested parties be present or represented
at the meeting and may be heard with respect to any proposition before the City
Commission in which the City Commission may take action. Should any person desire
to appeal any decision of the City Commission with respect to any matter to be
considered at this meeting, that person shall ensure that a verbatim record of the
proceedings is made including all testimony and evidence upon which any appeal may
be based (F.S. 286.0105).
Pursuant to Miami City Code Section 2-33(o), whenever a scheduled City Commission
meeting is cancelled or is not held due to a lack of a quorum or other emergency, a
special City Commission meeting will be automatically scheduled for the Tuesday
immediately following the cancelled meeting. In the event of one of the
aforementioned circumstances, the special meeting would be held on October 3,
2023, at 9:00 a.m. in the City Commission chambers located at Miami City Hall, 3500
Pan American Drive, Miami, FL 33133. All of the scheduled agenda items from that
cancelled meeting shall automatically be scheduled as an agenda item at the special
City Commission meeting.
The City Clerk shall notify the public of the special meeting that is to take place by
placing a notice of the special City Commission meeting at the entrance of City Hall
and the City's main administrative building, placing a notice on the City's website, and,
if feasible, placing an ad in a newspaper of general circulation before the special
meeting on the immediately following Tuesday. There shall be no additional notice by
publication required for any such scheduled agenda item that is moved to the special
City Commission meeting.
In accordance with the Americans with Disabilities Act of 1990, persons needing
special accommodations to participate in this proceeding may contact the Office of

the proceeding. TTY users may call via 711 (Florida Relay Service) no later than five
(5) business days prior to the proceeding.
