HomeMy WebLinkAboutO-14222City of Miami Ordinance 14222 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14561 Final Action Date: 10/26/2023 AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING CHAPTER 4/SECTION 4-6 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "ALCOHOLIC BEVERAGES/ ENTERTAINMENT DISTRICTS," MORE PARTICULARLY BY AMENDING THE "OVERTOWN ENTERTAINMENT DISTRICT" IN ORDER TO MODIFY THE DISTRICT'S BOUNDARIES AS DEPICTED IN EXHIBIT "O," ATTACHED AND INCORPORATED; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Commissioner Christine King WHEREAS, the State of Florida expressly allows municipalities to enact ordinances regulating alcoholic beverages with regards to hours of operation, locations of businesses, and types of entertainment among others; and WHEREAS, the City of Miami ("City") has incorporated regulations with respect to the sale of alcoholic beverages in Chapter 4 of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, On January 25, 2018, the City Commission adopted Ordinance No. 13734 regarding Alcoholic Beverages within the City, codified as Chapter 4 of the City Code; and WHEREAS, Chapter 4, Section 4-6 of the City Code creates certain "Entertainment Districts," which modify the distance requirements, number of available alcoholic beverage licenses, and hours of operation. WHEREAS, the City Commission adopted the Overtown Entertainment District, generally defined as properties fronting Northwest 2nd Avenue, from approximately Northwest 5th Street to Northwest 11 th Terrace, as depicted in Exhibit "0," attached and incorporated, to Section 4-6 of the City Code; and WHEREAS, the adoption of the Overtown Entertainment District has helped revive Northwest 2nd Avenue with new businesses, which helps accomplish the goals set out in the Historic Overtown Culture & Entertainment District Master Plan; and WHEREAS, while the Northwest 2nd Avenue corridor within the Overtown Entertainment District has seen growth and revitalization, the areas located West of Northwest 2nd Avenue to Interstate 95 consist of mostly vacant land and dilapidated structures; and WHEREAS, expansion of the Overtown Entertainment District to encompass the area from Northwest 2nd Avenue (to the east) to Interstate 95 (to the west) between Northwest 8th Street (to the south) and Northwest 11th Terrace (to the north), as depicted on Exhibit "0," attached and incorporated, will encourage the area's recovery, the adaptive reuse of existing structures, and removal of slum and blight; and City of Miami Page 1 of 2 File ID: 14561 (Revision: A) Printed On: 11/7/2023 File ID: 14561 Enactment Number: 14222 WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on September 20, 2023, following an advertised public hearing, adopted Resolution No. PZAB-R- 23-092 by a vote of eight to zero (8-0), Item No. PZAB.31, recommending approval of the City Code text amendment; and WHEREAS, the City Commission finds that it is in the best interest of the City to amend the Overtown Entertainment District boundaries as described herein; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Chapter 4, Section 4-6 of the City Code, titled "Alcoholic Beverages/ Entertainment Districts," is hereby amended by changing the boundaries of the Historic Overtown Culture and Entertainment District to encompass the areas from Northwest 2nd Avenue to Interstate 95 from Northwest 8th Street to Northwest 11th Terrace, as more particularly depicted on Exhibit "0," attached and incorporated.' Section 3. It is the intention that the provisions of this Ordinance shall become and be made a part of the Code of the City of Miami, Florida, which provisions may be renumbered or relettered and that the word "ordinance" may be changed to "section," "article," or other appropriate word to accomplish such intention. Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5.
