30-DAY NOTICE OF PUBLIC MEETING
TO AFFECTED PROPERTY OWNERS OF THE RE-ESTABLISHMENT OF THE
WYNWOOD BUSINESS IMPROVEMENT DISTRICT

I, TODD B. HANNON, City Clerk of the City of Miami, Florida, do hereby affirm, pursuant to
Section 170.07, Florida Statutes, on September 18, 2023, the required steps were executed in
sending the thirty (30) days' notice in writing to the owners of the three hundred and eighty-nine
(389) affected properties of the Wynwood Business Improvement District ("BID") re-establishment
to notify them of the place and time in which a public hearing will be held. The thirty days' notice
communicated that a public hearing will be held on October 26, 2023, at 10:00 a.m. at Miami City
Hall, located at 3500 Pan American Drive, Miami, Florida 33133, at which time the owners of the
properties to be assessed, or any other persons interested therein, may appear before the City
Commission and be heard as to the propriety and advisability of making such improvements, as
to the cost thereof, as to the manner of payment therefore and as to the amount thereof to be
assessed against each property so improved. Said notice included the amount to be assessed
and was served by certified mail to each property owner at his or her last known address. The
names and addresses of such property owners were obtained from the records of the property
appraiser or from such other sources as the City Clerk deemed reliable such as the preliminary
assessment roll contained in Resolution No. 23-0256 adopted on June 8, 2023, and updated by
the Wynwood BID on August 29, 2023, and on file with the City Clerk's Office.

TO BE KNOWN AS THE WYNWOOD BUSINESS IMPROVEMENT DISTRICT.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The City Commission hereby officially acknowledges the City Clerk's
Certification of the Canvass and Declaration of Results of the affidavit process, attached,
and incorporated as Exhibit "A," conducted pursuant to Resolution No. R-23-0256 during
the period of June 9, 2023 through August 18, 2023 for the re-establishment of a special
assessment district area to be known as the Wynwood Business Improvement District.
Section 2. This Resolution shall become effective immediately upon its adoption.'

CERTIFICATION AND DECLARATION OF RESULTS
OF THE AFFIDAVIT PROCESS TO RE-ESTABLISH THE
WYNWOOD BUSINESS IMPROVEMENT DISTRICT

CITY OF MIAMI
I, Todd B. Hannon, City Clerk of the City of Miami, Florida, do hereby certify that all
necessary legal steps were taken in connection with the conduct of the affidavit
process to re-establish the Wynwood Business Improvement District (hereinafter
referred to as "Wynwood BID"). The Wynwood BID opted to obtain approval of
affected property owners through an affidavit process that included having property
owners, or their authorized designee, execute an affidavit(s) in support of re-
establishing the Wynwood BID. All affidavits were required to be submitted to the
Office of the City Clerk no later than 5:00 P.M. on Friday, August 18, 2023.
I. On June 8, 2023, the Miami City Commission passed Resolution R-23-0256, to
re-establish the Wynwood BID; in addition to authorizing the levy and
collection of a special assessment for a period of ten (10) years subject to the
approval of a majority (50% plus one vote) of affected property owners within
the established boundaries of the Wynwood BID as identified in Composite
Exhibit A of Resolution R-23-0256.
II. The affidavit process, per agreement between the Wynwood BID, Office of the
City Attorney and Office of the City Clerk, involved the Wynwood BID
providing all affected property owners with an affidavit to register their
support of the re-establishment of the Wynwood BID. Furthermore, the
affidavits were required to be notarized and filed with the Office of the City
Clerk for the property owners, or their authorized designee, vote to be
counted. Affected property owners were entitled to submit a valid affidavit
per individual folio before the deadline. All affidavits were either to be hand
delivered or mailed to the Office of the City Clerk and received no later than
5:00 P.M. on Friday, August 18, 2023. Finally, a non -vote by any affected
property owner was to be considered a "no" vote.
III. I further certify that on Friday, August 18, 2023, at 5:00 P.M., the agreed upon
deadline for the City Clerk to have received all affidavits from owners of the
three hundred and eighty-nine (389) affected properties of the proposed re-
establishment of the Wynwood BID, a total of two hundred and fifty-six (256)
affidavits in support of the re-establishment had been filed with the Office of
the City Clerk and are open to inspection by the public.

IV. Two hundred and twenty-eight (228) of the two hundred and fifty-six (256)
filed affidavits received by the deadline were determined to be properly
executed and deemed valid.
Twenty-eight (28) of the two hundred and fifty-six (256) filed affidavits
received by the deadline were deemed invalid. The invalid affidavits consisted
of duplicate affidavits and incorrectly executed affidavits.
Furthermore, of the three hundred and eighty-nine (389) properties eligible
to vote in the affidavit process, one hundred and fifty-three (153) properties
did not submit an affidavit, and therefore were considered to be non -votes and
thus deemed "no" votes.
V. I further certify that the two hundred and twenty-eight (228) affidavits
deemed valid equals 58.6% of the properties located within the boundaries of
the Wynwood BID and therefore represents approval of a majority of the
affected property owners required for the re-establishment of the Wynwood
BID as stipulated in Resolution R-23-0256.

Chapter 170, Florida Statutes, provides municipal governments with the authority to levy
and collect special assessments against properties benefited in a retail business district for the
purposes of stabilizing and improving such district through promotion, management, marketing,
and other similar services in such districts, subject to approval by a majority of the affected
property owners.
The City Commission of the City of Miami (City Commission) adopted Resolution No.
R- 23-0256 on June 8, 2023, to re-establish the Wynwood Business Improvement District (BID) for
an additional ten (10) year period. The City Commission adopted Resolution No. R-23-0359 on
September 14, 2023, officially acknowledging that a majority of the affected property owners
approved the re-establishment of the BID.
The City Commission adopted Resolution No. R-23-0360 on September 14, 2023, in
accordance with Section 170.07, Florida Statutes, and scheduled a public meeting at which
affected property owners, or any other persons interested, may be heard as to the propriety and
advisability of making such improvements, as to the cost thereof, as to the manner of payment
therefore, and as to the amount thereof to be assessed against each property so improved.

other anti-Semitic slurs.
Yudel, serial -harasser of
the synagogue, disturbed
the service by blowing the
shofar, or ram's horn, a
ritual that's performed
during the High Holy Days
and refused to leave after
the rabbi asked him to,
according to the arrest
report.
Upgrading the misde-
meanor charge to a felony
is one of the fast uses of
the hate crime law in Mia-
mi -Dade since it was en-
acted earlier this year,
according to the Miami -
Dade State Attomey's
Office.
"Before House Bill 269,
this would have remained
as misdemeanor. And a
misdemeanor is a misde-
meanor, you're not going
to do time," said James
Somohano, director of
community security for the
Greater Miami Jewish
Federation. "The new
legislation makes it pos-
sible for that misdemeanor
to be bumped up to a felo-
ny hate crime ... And that's
a serious offense in Miami -
Dade."
Somohano's role, the
first of its kind at the Jew-
ish Federation, is to help
local synagogues, agencies
and schools stay prepared
against attacks. He said a
big part of his job is acting
as a liaison between the
Jewish community and law
enforcement when dealing
with hate crimes, as well as
educating police on the
new enhanced penalties.
The reason that it's
important to have the
statute is because we have
seen such an elevation in
anti-Semitic harassment
and crimes. HB 269 is a
fantastic tool, but it can't
stop there. There needs to
be more," said Somohano,
referencing the bill that
became law. Before joining
the Federation, Somohano
worked in Miami -Dade law
enforcement for over 36
years.
RELIGIOUS HATE
CRIMES ON RISE
Nationally, hate crime
mordents are on the rise,
increasing almost 12 per-
cent from 2020 to 2021,
according to an FBI report
on 2021 hate crimes. Reli-
gious -based hate crimes
made up a little over 15
percent of all incidents.
Though Jews make up less
than 3 percent of the U.S.
population, anti-Jewish
incidents accounted for
over half of all religious
hate crimes, the report
said.
Anti -Semitic incidents
are at an all-time high in
Florida, according to a
2022 audit released earlier
this year from the Anti -
Defamation League, a
nonprofit that tracks and
combats anti-Semitism and
other acts of hate. Last
year, Florida saw 269 acts
related to assault, harass-
ment and vandalism— a
42 percent increase since
2021 and the highest num-
ber of recorded anti-Semi-
tic incidents since ADL
began tracking them in
1979.
Many hate crimes targe
victims simply for who
they, while intimidating
entire communities, said
Lonny Wilk, deputy re-
gional director of ADL in
Florida.
"Hate crime laws, which
increase penalties or sen-
tences from criminals who
commit them, are a way
for society to recognize
that these crimes strike
fear in targeted groups and
fragment communities,"
he said.
Here's what to know
about the newly expanded
Florida hate crime laws:
WHAT IS THE NEW
FLORIDA LAW?
Florida statute 784.0493
— "Harassment or intimi-
dation based on religious
or ethnic heritage" — is a
part of House Bib 269, the
"Public Nuisances" bill,
which was signed into law
on May 1 and went into
effect immediately. The
law covers a variety of
crimes, including dumping
litter on private property
and making threats to
public universities.
The statute relates to
religious or ethnic -based
hate crimes and states that
someone who willfully and
maliciously harasses or
intimidates another person
based on their religion or
ethnicity can be charged
with a firstdegree misde-
meanor. But if the person,
while committing the ha-
rassment, makes a credible
threat to the other parties,
then the violation is a
third-degree felony.
Another new state law,
Florida statute 775.085,
reclassifies hate crime
offenses to include harsher
punishments. For example,
a second-degree misde-
meanor is now reclassified
to a first -degree misde-
meanor— a charge treated
with more severity— and a
fast -degree misdemeanor
is reclassified to a third-
degree felony, and so on.
WHAT MAKES
SOMETHING A"HATE
CRIME?"
Hate crime offenses in
Florida include acts com-
mitted based on the race,
color, ancestry, ethnicity,
religion, sexual orienta-
tion, national origin,
homeless status, or ad-
vanced age of the victim.
This kind of crime might
look like a group of white
teenagers threatening a
Black teenager while using
racial slurs, a gay man who
is physically assaulted in
front of a gay bar, or a
bomb threat called into an
Islamic center, according
to the State Attomey's
website.
Hate speech alone would
not constitute a hate crime
under the First Amend-
ment. But hate speech
coupled with another of-
fense, such as defacing
public property or harass-
ment, is considered a hate
crime.
"Unless it falls into one
of these other categories of
unprotected speech, just
saying hateful things about
a group of people is pro-
tected in the United States.
That's First Amendment
law," said Caroline Male
Corbin, professor of law at
the University of Miami
School of Law.
Categories of unprotect-
ed speech include true
threats, defamation and
mating lawless action.
"The United States is
unusually protective of free
speech, much more so than
most other countries," said
Corbin. "And one of the
consequences of that is
hate speech is protected."
As of this year, under the
Hate Crimes Reporting
Act, Florida now requires
the state government and
law enforcement to collect
and disseminate data on
all hate crimes. Miami -
Dade County also has a
Hate Crimes Unit Hot line
(786) 687-2566.
WHAT ELSE DOES THE

The law also makes
changes to an existing
statute, which prohibits
someone from maliciously
interrupting any school or
religious assembly, such as
a church service or tuner -

as a deterrent remains to
be seen, but experts says
the law is key toward com-
bating hate crimes.
"It is essential that law
enforcement have the
tools that are needed to
effectively prosecute hate
comes," said Brian Siegal,
Miami-Broward regional
director of the American
Jewish Committee, an
advocacy group. "Many
synagogues and other
Jewish institutions have
been forced to take ex-
treme security measures
because of such threats.
We want to send a clear
signal that religiously
motivated attacks have no
place in Florida"
But many advocacy
groups believe the hate
crime laws in Florida don't
go far enough.
"Florida's hate crime
law is not comprehen-
sive," said Wilk of the
ADL. "It does not cover
the categories of gender,
gender identity and phys-
ical disability."
Additionally, it takes
time to inform the public
and the police about the
new laws, which is the
case with House BID 269,
said Somohano, the feder-
ation's new security direc-
tor.
"It's not that law en-
forcement doesn't want to
pursue individuals that
commit these crimes, it's
that sometimes they are
unaware of all of the tools
that they have," said So-
mohano. "More and more
agencies are aware of
House Bill 269. More and
more of them are looking
for how to properly apply
it."

Arab paramedic who
treated Israelis
injured by Hamas
terror attack is
remembered as hero

When Hamas unleashed
its attack on thousands of
Jews attending a music
festival in southern Israel
this month, an Israeli -
Arab paramedic insisted
on staying to try to save
lives.
In the end, he gave his
Awad Darawshe was 23,
single, handsome - but he
wasn't at the Tribe of
Nova festival to dance. He
worked for Yossi Ambu-
lances and was among a
team of paramedics as-
signed to work the festival
n a tent on the site's pe-
riphery.
He was killed when
Hamas militants slipped
into Israel from the Gaza
Strip and butchered their
way through the festival
crowd and into nearby
villages, settlements and
kibbutzim.
Shortly after dawn on
Oct 7, rockets pierced the
skies. Grenades went off.
Gunfire ricocheted every-
where. Injured, bleeding
revelers raced to the para-
medics' station. But the
chaos quickly escalated.
As the scope of the Hamas
attack became clear, the
station's leader ordered
the paramedics to evac-
uate.
Darawshe refused to
leave. He was shot to
death while bandaging
one of the injured.
Days later, after his
body was identified, the
surviving paramedics told
Awad Darawshe was shot
to death while bandaging
one of the injured at the
music festival that Haman
attacked on Oct. 7.
Darawshe's family why he
had chosen to stay. He felt
that, as an Arab, he could
somehow mediate with
the attackers.
"He said, `No, I'm not
leaving. I speak Arabic, I
think I can manage,'
said his cousin, Moham-
mad Darawshe, who spoke
to The Associated Press by
telephone from his home
in norther Israel.
That decision has left
Darawshe's relatives reel-
ing with sorrow, their only
comfort the bravery of
Awad's actions.
"He brought us a lot of
pain, he brought us a lot of
agony, he brought us a lot
of sorrow," his cousin
said. "But he also brought
us a lot of pride - because
he chose to stay with his
mission until the last mo-
ment"

hate -crime charges while
the boy's Muslim family
prepared to bury him in the
Chicago area

had just turned 6, had been
stabbed multiple times

response to a 911 call.
"Detectives were able to
determine that both victims
in this brutal attack were
targeted by the suspect due
to them being Muslim and
the ongoing Middle Eastem
conflict irnolving Hamas
and the Israelis," the sher-
iffs office said.
The boy's mother told
investigators she rents two
rooms on the fast floor of
the Plainfield home while

has lived in Iksal for gen-
erations and is part of
Israel's Palestinian -Arab
minority that makes up
about 20% of the pop-
ulation. The Darawshes
are the descendants of
Palestinians who stayed in
the country after the 1948
war surrounding Israel's
creation. Unlike Palesti-
nians living in the occu-
pied West Bank and Gaza,
they are full citizens of
Israel, but they face wide-
spread discrimination.
Tensions between them
and Jewish Israelis flare
repeatedly, particularly in
times of war.
The festival attack left
at least 260 Israelis dead
and an undetermined
number were taken hos-
tage. In Saturday's brutal
attack by Hamas, more
than 1,3001sraelis were
killed altogether, the worst
massacre in the country's
history. Israel declared
war on Hamas the follow-
ing day.
Darawshe's death was
confirmed by the Israeli
Foreign Ministry in sodal-
media posts, which said
Hamas also stole his am-
bulance and drove it to
Gaza. "A hero," the For-
eign Ministry said of Da-
rawshe. "May his memory

said it opened a hate -crime
investigation into the at-
tack
