TO THE CITY OF MIAMI, DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT, ADMINISTRATIVE ACCOUNT, SPECIFIED IN EXHIBIT "A", ATTACHED AND INCORPORATED; FUTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS, FOR SAID PURPOSE. Background of Item: Pursuant to Resolution No. 21-0443, adopted on October 28, 2021, the City of Miami ("City") commission approved the allocation of the ERAP 2 funds in an amount of $22,779,317.10 ("Funds") from the Treasury Department, which included an amount of $125,000.00 to Legal Services of Greater Miami, Inc. to provide legal assistance to the City of Miami residents who were negatively affected by the Coronavirus pandemic. On May 4, 2022, an agreement for $75,000.00 was signed between the "City" and the Legal Services of Greater Miami, Inc. On November 4, 2022, amendment #1 was executed between the parties for an additional $50,000.00. Legal Services of Greater Miami, Inc. served over 138 clients; however, the agreement expired on May 2, 2023, leaving an unspent amount of $55,571.03. The ERAP 2 has ended and there is no further need for the services offered by Legal Services of Greater Miami, Inc. The City Administration recommends reallocating Emergency Rental Assistance Program ("ERAP 2") funds in the amount of $55,571.03 from Legal Services of Greater Miami, Inc. to the City of Miami, Department of Housing and Community Development, Administrative Account, specified in Exhibit "A", attached, and incorporated. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The reallocation of the ERAP 2 funds in the total amount of $55,571.03 from Legal Services of Greater Miami, Inc. to the City's Department of Housing and Community Development, Administrative Account, as specified in Exhibit "A," attached, and incorporated, is approved. Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, including agreements, amendments, extensions, and modifications, all in forms acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use of such funds for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption.
