AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED ("MIAMI 21 CODE"), SPECIFICALLY BY AMENDING
ARTICLE 5, TITLED "SPECIFIC TO ZONES," TO PERMIT CITY OF MIAMI
("CITY") OWNED OR CITY -FUNDED AFFORDABLE HOMEOWNERSHIP
SINGLE-FAMILY RESIDENCES AND TWO-FAMILY HOUSING LOCATED IN
THE T4 OR T5 TRANSECT ZONES TO UTILIZE THE DEVELOPMENT
STANDARDS OF THE T3 TRANSECT ZONE; MAKING FINDINGS;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.

WHEREAS, the City of Miami ("City") wishes to modify the regulations pertaining to
affordable housing in Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida,
as amended ("Miami 21 Code"); and
WHEREAS, the Miami 21 Code is form based, carefully regulating the disposition of
structures on properties depending upon the transect zone in which the property lies; and
WHEREAS, while the Miami 21 Code permits single-family homes and duplexes in more
intense transect zones, the structure is required to meet the applicable transect zone's design
standards for placement of the building close to the property line, paving the front setback area,
and other requirements that result in a structure that is not conducive to a single-family or
duplex home; and
WHEREAS, the City wishes to assist affordable housing programs involving City -owned
properties or properties where the City is financing a single-family home or duplex by permitting
such structures to be constructed in the same manner as if they were located in a zone
permitting predominantly those uses, such as the T3 Transect Zone; and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on
September 20, 2023, following an advertised public hearing, adopted Resolution No. PZAB-R-
23-R-087 by a vote of eight to zero (8-0), Item No. PZAB.22, recommending approval of the
Miami 21 Code amendment; and
WHEREAS, the City Commission has considered whether the proposed text amendment
as stated herein will further the goals, objectives, and policies of the Miami Comprehensive
Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and
WHEREAS, consideration has been given to the need and justification for the proposed
text amendment, including changed or changing circumstances; and

WHEREAS, the City Commission finds that it is in the best interest of the City and its
residents to approve the Miami 21 Code amendment as stated herein;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Article 5 of the Miami 21 Code is hereby amended with the following
particulars:'
"ARTICLE 5. SPECIFIC TO ZONES
5.1 GENERALLY
5.1.1
This Article sets forth the standards applicable to development within each Transect Zone that
are specific to:
• Building Disposition
• Building Configuration
• Building Function and Density
• Parking Standards
• Architectural Standards
• Landscape Standards
• Ambient Standards
City -owned or City -funded affordable homeownership Single -Family Residence or Two -Family
Housing in T4 or T5 Transect Zones may utilize the development standards applicable to T3-L
and T3-O, respectively.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. It is the intention of the City Commission that the provisions of this
Ordinance shall become and be made a part of the Zoning Ordinance of the City of Miami,
Florida, which provisions may be renumbered or relettered and that the word "ordinance"

may be changed to "section", "article", or other appropriate word to accomplish such
intention.
Section 5. The Ordinance shall become effective 10 (ten) days after adoption
hereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
