HomeMy WebLinkAboutLegislation-SUB"tit 0R`O City of Miami Resolution R-23-0390 Legislation City Hall 3500 IPan Arnerican Drive Miami, FL 33133 www.miamigov.com File Number: 14575 Final Action Date: 9/14/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH MIAMI RIVER FUND, INC., A FLORIDA NOT -FOR -PROFIT 501(C)(3) CORPORATION, AS THE FINANCIAL AGENCY FOR THE MIAMI RIVER COMMISSION, TO PROVIDE LANDSCAPE MAINTENANCE, LITTER AND DEBRIS PICKUP, AND OTHER RELATED SERVICES TO MAINTAIN THE MIAMI RIVER GREENWAY IN CERTAIN CITY RIGHTS -OF -WAYS, AS DEPICTED IN EXHIBIT "A", ATTACHED AND INCORPORATED, FOR A TWO (2) YEAR TERM, WITH AN OPTION TO RENEW FOR ONE (1) ADDITIONAL ONE (1) YEAR PERIOD, IN AN AMOUNT NOT TO EXCEED THREE HUNDRED FIFTEEN THOUSAND DOLLARS ($315,000.00) ANNUALLY; ALLOCATING FUNDS FROM SPECIAL REVENUE ACCOUNT NO. 13000.201000.534000.0000.00000 FOR SAID PURPOSE, SUBJECT TO AVAILABILITY OF FUNDS AND PRIOR BUDGETARY APPROVAL; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING AMENDMENTS, RENEWALS, AND EXTENSIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, AND PRIOR BUDGETARY APPROVALS, AND IN COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS; PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Commissioner Joe Carollo WHEREAS, the City of Miami ("City") and the Miami River Commission ("MRC") have an interest in the health and cleanliness of the Miami River; and WHEREAS, the MRC was established by Section 163.06, Florida Statutes, as the official clearinghouse for all public policy and projects related to the Miami River and is funded by the Florida Department of State, Florida Department of Transportation, Miami -Dade County, the City, and private sector donations; and WHEREAS, the City requires landscaping maintenance, litter and debris pickup, and other related services (the "Services") in City rights -of -way located adjacent to the Miami River, as depicted in Exhibit "A," attached and incorporated ("City ROW'); and WHEREAS, the MRC agrees to provide the Services in conjunction with its other ongoing projects to maintain the health and beauty of the Miami River; and City of Miami Page 1 of 2 File ID: 14575 (Revision: A) Printed On: 10/17/2023 File ID: 14575 Enactment Number: R-23-0390 WHEREAS, Section 18-112 of the Code of the City of Miami, Florida, as amended ("City Code"), authorizes the City to enter into an agreement with other governmental agencies or state funded institutions for the purchase or acquisition of goods or services without competitive bidding procedures subject to City Commission approval for purchases over $50,000.00; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to negotiate and execute an agreement, in a form acceptable to the City Attorney, with Miami River Fund, Inc., a Florida not - for -profit 501(c)(3) corporation, as the financial agency for the MRC, to provide the Services to maintain the Miami River Greenway in City ROW for a two (2) year term, with an option to renew for one (1) additional one (1) year period, in an amount not to exceed three hundred fifteen thousand dollars ($315,000.00) annually. Section 3. Funds are hereby allocated from Special Revenue Account No. 13000.201000.534000.0000.00000 for said purpose, subject to the availability of funds and prior budgetary approval. Section 4. The City Manager is further authorized' to negotiate and execute any and all other documents, including any amendments, renewals, and extensions, all in forms acceptable to the City Attorney, as may be deemed necessary for said purpose, subject to all allocations, appropriations, and prior budgetary approvals, and in compliance with all applicable provisions of the City Code, and in compliance with all applicable laws, rules, and regulations. Section 5. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: 9/5/2023 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
